An Easement for the Purpose of Conveying Coal Over Land Acquired for Works, Appliances and Conveniences Necessary for the Generation of Electricity in Block XI, Rangiriri Survey District, Raglan County
Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, agreements to that effect having been entered into, the easement for the purpose of conveying coal, described in the First Schedule hereto, is hereby acquired for works, appliances and conveniences necessary for the generation of electricity over the land described in the Second Schedule hereto on the 1st day of April 1982.
FIRST SCHEDULE
South Auckland Land District
Description of Easement

In this Schedule the term "grantor" means the owner of the land over which an easement is to be granted and the term "grantee" means the Crown.

The full, free, uninterrupted, and unrestricted right, liberty, and privilege in perpetuity for the grantee by its engineers, officers, agents and workmen, to take, convey, and lead coal in a free and unimpeded flow along over or under the said land.

To lay, place, and maintain along over or under the said land all necessary equipment for the purpose of conveying coal sufficient for the requirements of the grantee.

To construct, maintain the efficiency, or renew any such equipment, the full, free, uninterrupted, and unrestricted right, liberty and privilege in perpetuity for the grantee by its engineers, officers, agents and workmen, with any tools, implements, machinery, vehicles, or equipment of whatsoever nature necessary for the purpose to enter upon the said land and upon adjoining land of the grantors by such route as is reasonable in the circumstances and to remain there for any reasonable time for the purpose of erecting, laying, inspecting, cleaning, repairing, maintaining and renewing the coal conveying equipment or any part thereof and of opening up the soil of the said land to such extent as may be necessary and reasonable in that regard.

To prohibit or regulate the erection of any structures or carrying out any activity adjoining the said land which could in the opinion of the grantee be detrimental to the operation of the coal conveying equipment.

To fence the boundaries of the said land if in the opinion of the grantee it is considered necessary and to the extent the grantee shall determine.
