Land and Easements Over Land Acquired for Electricity Works in Block V, Otanewainuku Survey District, Tauranga County

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development hereby declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for electricity works and the easement firstly described in the Second Schedule hereto and the right of way easement secondly described in the said Second Schedule is hereby acquired for electricity works over the land secondly described in the said Third Schedule and that both the land and easements shall vest in The Tauranga City Council on the 25th day of March 1982.

SECOND SCHEDULE

Description of Easements

1. An easement in gross over and along the land firstly described in the Third Schedule hereto for the full and free right for The Tauranga City Council, The Tauranga Electric Power Board and The Tauranga Joint Generation Committee and their respective agents, employees, engineers and contractors in common with Arthur Ballantyne Scott and his successors in title from time to time and at all times by day and by night forever hereafter to pass and re-pass with or without such vehicles, implements, or machinery as may be required by The Tauranga Joint Generation Committee to maintain and protect its culvert, dam, tunnel intakes, tunnels and other works erected by it on the Mangakarengorengo River and to install and maintain in the area of its works any measuring or other device necessary for the maintenance of its works and generally for all purposes connected with and enabling The Tauranga City Council, The Tauranga Electric Power Board or The Tauranga Joint Generation Committee to police and carry into effect their policy from time to time

for the management and control of the waters diverted from the Mangakarengorengo River to Lake McLaren. The carriage-way of the right of way shall be formed, metalled and maintained at the expense of The Tauranga City Council in all things.

2. An easement in gross over and along the land secondly described in the Third Schedule hereto for the full and free right for The Tauranga City Council, The Tauranga Electric Power Board and The Tauranga Joint Generation Committee by their respective agents, employees, engineers and contractors in common with Arthur Ballantyne Scott and his successors in title from time to time and at all times by day and by night forever hereafter to pass and re-pass on foot with or without such tools or equipment as those persons may require to main and protect the electricity works on the Mangakarengorengo River and generally for all purposes connected with and enabling The Tauranga City Council, The Tauranga Electric Power Board and The Tauranga Joint Generation Committee to police and carry into effect The Tauranga Joint Generation Committee’s policy from time to time for the management and control of the diversion of the waters of the Mangakarengorengo River into Lake McLaren.
