FIRST SCHEDULE

ALL that area in the Otago Land District, Silverpeaks County, containing 2680 square metres, more or less, bounded by a line commencing at the westernmost corner of Lot d, Deeds Plan 244, Irregular Block East Taieri Survey District and proceeding south-westerly along the southern boundary of Lot c, Deeds Plan 244, and its production to the eastern side of Riccarton Road; thence south-easterly along that roadside to the south-western corner of part Lot b, Deeds Plan 244 (certificate of title 264/124, Otago Registry); thence southeasterly along the southern boundaries of part Lot b, Deeds Plan 244, and part Section 36 (certificate of title 264/117, Otago Registry), Irregular Block East Taieri Survey District to the south-eastern corner of part Section 36 aforesaid; thence north-westerly along the north-eastern boundary of part Section 36 to the point of commencement.

All that area in the Otago Land District, Silverpeaks County, containing 504 square metres, more or less, bounded by a line commencing at the eastern corner of Lot 1, D.P. 4677, Irregular Block East Taieri Survey District and proceeding south-easterly along the western boundary of Lot 1, D.P. 9278, Irregular Block East Taieri Survey District to the southernmost corner of that Lot; thence generally northerly along the eastern boundary of Lot 1, D.P. 9278, to the north-eastern corner of Lot 1 aforesaid; thence south-westerly along a right line to the point of commencement.

SECOND SCHEDULE

ALL that area in the Otago Land District, Mosgiel Borough, containing 480 square metres, more or less, bounded by a line commencing at the north-western corner of Lot 1, D.P. 4677, Irregular Block East Taieri Survey District and proceeding south-easterly along the western boundary of Lot 1, D.P. 4677, to the south-western corner of Lot 1 aforesaid; thence north-westerly along a right line to the eastern corner of part Section 36 (certificate of title 25/178, Otago Registry); thence north-westerly along the eastern boundary of that part Section 36 to the south-eastern side of State Highway No. 1; thence north-easterly along the roadside to the point of commencement.

All that area in the Otago Land District, Mosgiel Borough, containing 166 square metres, more or less, bounded by a line commencing at the northern corner of Lot 1, D.P. 9278, Irregular Beck East Taieri Survey District and proceeding north-easterly along the south-eastern side of State Highway No. 1 to the western boundary of Lot 1, D.P. 7573; thence south-easterly along that boundary to the southern corner of Lot 1, D.P. 7573, aforesaid; thence south-westerly along a right line to the eastern boundary of Lot 1, D.P. 9278; thence north-westerly along the eastern boundary of that Lot to the point of commencement.

Mount Wellington Borough Council Foreshore Control Order 1982

ORDER IN COUNCIL

At the Government House at Wellington this 18th day of October 1982

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. Title and commencement—(1) This order may be cited as the Mount Wellington Borough Council Foreshore Control Order 1982.

(2) This order shall come into force on the 1st day of November 1982.

  1. Interpretation—In this order—

“The Act” means the Harbours Act 1950;

“The Council” means the Mount Wellington Borough Council constituted under the Local Government Act 1974.

“Foreshore” means such parts of the bed, shore or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tides.

  1. Grant of Control—There is hereby granted to the Council for a period of 6 years from the 1st day of November 1982 and ending with the 31st day of October 1988 control of the foreshore described in the Schedule to this order.

  2. Conditions of Grant—The grant of control conferred by clause 3 of this order is subject to the following conditions—

(a) Suitably worded signs shall be erected at main public access ways to the foreshore, described in the Schedule to this order, indicating that control of the foreshore has been granted to the Council pursuant to section 165 of the Act.

(b) All money received by the Council in the performance or exercise of the functions, duties or powers conferred on it by this order in respect of the foreshore to which this order applies, shall, after the deduction of any expenditure incurred by the Council in the performance or exercise of those functions, duties, or powers, be applied to the construction, repair or improvement of facilities in respect of that foreshore and not otherwise.

SCHEDULE

ALL that area of foreshore fronting Mount Wellington Borough on the west bank of the Tamaki River commencing at the eastern corner of Lot 5, D.P. 300, at the southern boundary of Kings Road, thence generally in an easterly direction to a point off the eastern corner of the recreation reserve (S.O. 45496) and as more particularly shown on plan MD 15390, deposited in the office of the Secretary of Transport at Wellington.

EXPLANATORY NOTE

This note is not part of the order, but is intended to indicate the area subject to the order.

The area described in the Schedule to this order includes the foreshore area upstream and downstream of the Panmure wharf on the west bank of the Tamaki River.

Major Robyn Grace Stephens is transferred to the Reserve of Officers, General List, in her present rank with effect from 11 August 1982.

ROYAL N.Z. CORPS OF SIGNALS

Lieutenant J. O. Thomson, B.A.(MIL.), to be temp. Captain with effect from 28 June 1982.

Lieutenant and Quartermaster Herbert George Cantrick is posted to the Retired List with effect from 4 September 1982.

ROYAL N.Z. INFANTRY REGIMENT

Lieutenant Colonel Laurence James Lynch is transferred to the Reserve of Officers, General List, in his present rank with effect from 3 August 1982.
