The Invercargill City Council is granted by the Order
control of the foreshore of Oreti Beach, New River Harbour,
the Oreti River downstream of the Dunns Road Bridge, the
Waihopai River and the foreshore southward to Barracouta
Point.

Waters Control Order 1982

At the Government House at Wellington this 26th day of
October 1982

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 8A of the Harbours Act 1950, His
Excellency the Governor-General, acting by and with the
advice and consent of the Executive Council, hereby makes
the following order.

ORDER

  1. Title and commencement—(1) This order may be cited as
    the Wanganui River, Ongarue River and Retaruke River
    Waters Control Order 1982.
    (2) This order shall come into force on the 1st day of
    November 1982.

  2. Interpretation—In this order—

“The Act” means the Harbours Act 1950:

“The Commissioner” means the Commissioner of Crown
Lands, Wellington.

  1. Grant of Control—There is hereby granted to the
    Commissioner for a period of 21 years, commencing with the
    1st day of November 1982 and ending with the 31st day of
    October 2003, control of the waters described in the Schedule
    to this order.

  2. Powers of Commissioner—Subject to section 8A of the
    Act, the Commissioner may, in respect of the waters to which
    this order applies—

(a) By bylaw, do anything which a Harbour Board may do
by bylaw under section 232 of the Act.

(b) Appoint harbourmasters and other officers and define
or limit their powers and duties.

  1. Revocations—The following orders are hereby revoked—

(a) The Wanganui River Scenic Board Waters Control Order
1975*, and

(b) The Wanganui River Scenic Board Waters Control Order
1975, Amendment No. 1†.

SCHEDULE

ALL those waters of the Wanganui River commencing at a
line across the river bearing 134° true from the southern
corner of Raorikia Maori Reserve and extending upstream to
a line passing due north across the river through the northern-
most tip of Whakapapa Island as more particularly shown on
plan MD 15611, deposited in the office of the Secretary for
Transport at Wellington.

All those waters of the Ongarue River, extending upstream
from the confluence of the Wanganui River and the Ongarue
River to the State Highway No. 4 bridge as more particularly
shown edged red on plan MD 16042, deposited in the office
of the Secretary for Transport at Wellington.

All those waters of the Retaruke River, extending 700
metres upstream from the confluence of the Wanganui River
and the Retaruke River as more particularly shown on plan
MD 16043, deposited in the office of the Secretary for
Transport at Wellington.

Mosgiel Borough—Silverpeaks County Boundaries Alteration
Order 1982

October 1982

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Local Government Act 1974, His Excellency
the Governor-General, acting by and with the advice and
consent of the Executive Council, hereby makes the following
order:

ORDER

  1. Title and commencement—(1) This order may be cited the
    Mosgiel Borough—Silverpeaks County Boundaries Altera-
    tion Order 1982.
    (2) This order shall come into force on the 1st day of
    April 1983.

  2. Boundaries of Silverpeaks County and Mosgiel Borough
    altered—The boundaries of Silverpeaks County and Mosgiel
    Borough shall be altered by:

(a) Excluding from Silverpeaks County and including in
Mosgiel Borough the areas described in the First
Schedule to this order; and

(b) Excluding from Mosgiel Borough and including in
Silverpeaks County the areas described in the Second
Schedule to this order.

  1. Effect on ridings—The areas described in the Second
    Schedule to this order shall form part of the Otokaia Riding
    in Silverpeaks County.

  2. Transfer of powers, functions and other responsibilities—
    The Mosgiel Borough Council, in respect of the areas described
    in the First Schedule to this order, and the Silverpeaks
    County Council, in respect of the areas described in the
    Second Schedule to this order:

(a) Shall have and may exercise and be responsible for all
the powers, duties, acts of authority, and functions
which have been so exercised, or which would have
been so exercised, by the territorial authority
from whose district the areas are hereby excluded;

(b) Shall have and may exercise and be responsible for all
liabilities, obligations, engagements, and contracts
which previously were, or which would have been,
the responsibility of the territorial authority from
whose district the areas are hereby excluded;

(c) Shall have and may exercise and be responsible for all
actions, suits, and proceedings pending by or against,
or which would have been the responsibility of, the
territorial authority from whose district the areas
are hereby excluded;

(d) Shall succeed to the bylaws which are in force and
which are applicable to the authority’s altered cir-
cumstances and, until revoked or altered by such
authority, every such bylaw shall remain in force
in the area in which it was in force immediately
before the alteration of boundaries; and every bylaw
which cannot be restricted to the area shall be
deemed inapplicable and revoked in respect of the
area by the alteration of boundaries;

(e) Shall succeed to all rates or levies and other money
payable to the territorial authority from whose district
the areas are hereby excluded;

(f) Shall succeed to the valuation rolls, electoral rolls, and
rate records in force in the area, and these shall
remain in force until such rolls or records are made
for it; and until that time Part IX of the Rating
Act 1967 shall apply as if the district in which those
areas were included was the district of a special
purpose authority and the areas from which it was
formed were constituent districts.

  1. Vesting of land—The corporation of Mosgiel Borough
    in respect of the areas described in the First Schedule to this
    order, and the corporation of Silverpeaks County in respect
    of the areas described in the Second Schedule to this order,
    shall have vested in it, subject to all existing encumbrances,
    all land in the areas vested in the corporation of the terri-
    torial authority from which the areas are excluded.

  2. Mayor, chairman and principal administrative officer—
    The mayor and principal administrative officer of the Mosgiel
    Borough Council shall exercise the duties, powers, and func-
    tions of the chairman and principal administrative officer of
    the Silverpeaks County Council in respect of the areas
    described in the First Schedule to this order; and the chair-
    man and principal administrative officer of the Silverpeaks
    County Council shall exercise the duties, powers, and functions
