Land Acquired for the Auckland-Hamilton Motorway in the City of Papatoetoe

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for the Auckland-Hamilton motorway, and shall vest in the Crown on the 14th day of October 1982.

Declaring Easements Over Land Acquired for a Water Race in the Borough of Dannevirke

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, an easement in gross is hereby acquired for a water race, vesting in The Dannevirke Borough Council (called “the grantee”), the right to convey water across the land described in the Schedule hereto, such grant being in accordance with paragraph 2 of the Seventh Schedule to the Land Transfer Act 1952, together with the additional rights contained in paragraph 5 of the said Seventh Schedule, provided that (1) the grantee will keep and maintain at its own cost the pipeline or pipelines in good and serviceable repair and shall not nor will allow the same to fall into disrepair nor do damage of any kind nor become a nuisance by bursting, leakage or other cause whatsoever and shall take all necessary steps to protect persons and stock from injury; (2) the grantee will at all times hereafter during the existence of this grant indemnify and save harmless the owners of the said land from and against all claims, charges or proceedings that may in any way arise out of or be referable to the existence of the grant or the exercise of the rights hereby conferred on the grantee; (3) if in the construction of the pipeline or pipelines or in the maintenance thereof the grantee is required to dig up the pasture or dismantle any fences or gates upon the said land or if by constructing the said pipelines or pipelines or in maintaining the same the grantee damages or disturbs any of the improvements upon the said land then and in any such case the grantee shall restore the pasture, fences, gates or other improvements to the same good condition that they were formerly in; (4) all legal and survey costs of and incidental to this agreement and to the taking of the grant under the Public Works Act 1981 and all other expenses whatsoever of and incidental to this grant shall be paid by the grantee; (5) notwithstanding the provisions of clauses 1 and 3 hereof if any maintenance or other work as therein required to be carried out by the grantee is caused by the wilful or negligent act or omission of the said owners or their servants or agents, licensees and invitees then the said owners shall reimburse the grantee for the full cost of all such maintenance or other work; (6) if at any time any dispute, question or difference shall arise between the parties touching the construction or meaning of this grant or any clause hereof then every such dispute, question or difference shall be referred to arbitration in the normal manner and this clause shall be deemed to be a submission within the meaning given to that word by the Arbitration Act 1908.

Land Acquired, Subject to and together with Certain Rights, for Hospital Purposes in the City of New Plymouth

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired, together with and subject to the rights of way and right to convey water contained in easement certificate 136179, subject to the drainage pipeline and incidental rights created by Transfer 66020, to the stormwater, pipeline and incidental rights created by Transfer 136103, to rights incidental to water and pipeline rights created by Transfer 136104 to the building line condition in special order 132943, to the fencing covenant in Transfer 149283, and to the right of way granted by Transfer 157005, for hospital purposes, and shall vest in The Taranaki Hospital Board, on the 14th day of October 1982.
