Redefining the Limits of Westport Harbour

At the Government Buildings at Wellington this 20th day of September 1982

Present:

THE RIGHT HON. D. MACINTYRE PRESIDING IN COUNCIL

PURSUANT to section 3 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby redefines the limits of the Port of Westport as described in the Schedule hereto and hereby revokes the warrant of 8 February 1901* defining the Port of Westport.

SCHEDULE

ALL that area of water bounded by a line commencing at the waters edge at high water ordinary spring tide, 3 miles north-east of the true left bank of the mouth of the Ngakawau River thence on a bearing 310° true distance 3 miles thence by a line to Cape Fowlwind lighthouse, as shown by lines coloured red on plan MD 16126 deposited in the office of the Secretary for Transport at Wellington.

Extending the Time Within Which the Commission of Inquiry Appointed to Consider and Advise Upon an Application for a Pipeline Authorisation for a Liquefied Petroleum Gas Pipeline Between Lyttelton and Woolston May Report

To all to whom these presents shall come, and to—

His Honour Judge PETER ROBERT SKELTON of Christchurch, Chairman of the Number Three Division of the Planning Tribunal;

GILBERT WILLIAM ENSOR of Tirau, member of the Number Three Division of the Planning Tribunal;

ROY ALEXANDER MCLENNAN of Nelson, member of the Number Three Division of the Planning Tribunal; and

THOMAS WALTON SMALLFIELD of Herne Bay, member of the Number One Division of the Planning Tribunal:

GREETING:

WHEREAS by Orders in Council made on the 26th day of April 1982* and on the 21st day of June 1982, you, the said Peter Robert Skelton, Gilbert William Ensor, Roy Alexander McLennan, and Thomas Walton Smallfield were appointed to be a Commission to inquire into and report upon an application for a pipeline authorisation for a liquefied petroleum gas pipeline between Lyttelton and Woolston:

And whereas by the said Orders in Council you were required to submit your findings and opinions on the matters set out therein together with such advice as you thought fit to make in respect thereof not later than the 30th day of September 1982:

And whereas it is expedient that the time for so reporting should be extended as hereinafter provided:

Now, therefore, pursuant to the Commissions of Inquiry Act 1908, I, The Honourable Sir David Stuart Beattie, the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council, hereby extend until the 22nd day of December 1982 the time within which you are so required to report, without prejudice to the continuation of the liberty conferred upon you by the said Orders in Council to report your proceedings and recommendations from time to time if you should judge it expedient so to do, and hereby confirm the said Orders in Council and the Commission thereby constituted, save as modified by these presents.

Given in Executive Council under the hand of His Excellency the Governor-General this 27th day of September 1982.

Replacement of Member of Commission of Inquiry Appointed to Consider and Advise Upon an Application for a Pipeline Authorisation for a Liquefied Petroleum Gas Pipeline Between Lyttelton and Woolston

To all to whom these presents shall come, and to—

REGINALD ERNEST HERMANS of Hamilton, member of the Number One Division of the Planning Tribunal;

ROY ALEXANDER MCLENNAN of Nelson, member of the Number Three Division of the Planning Tribunal; and

THOMAS WALTON SMALLFIELD of the City of Waitemata, Engineer:

GREETING:

WHEREAS by an Order in Council made on the 26th day of April 1982*, you, the said Peter Robert Skelton, Gilbert William Ensor, Reginald Ernest Hermans, and Roy Alexander McLennan, were appointed to be a Commission to inquire into and report upon an application for a pipeline authorisation for a liquefied petroleum gas pipeline between Lyttelton and Woolston:

And whereas you, the said Reginald Ernest Hermans, are no longer able to serve as a member of the said Commission and have asked to be relieved from the duty of so doing, and it is desirable to appoint you, the said Thomas Walton Smallfield, to be a member of the said Commission in the stead of the said Reginald Ernest Hermans:

Now, therefore, pursuant to section 54 of the Petroleum Act 1937 and to the Commissions of Inquiry Act 1908, I, The Honourable Sir David Stuart Beattie, the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council, hereby relieve you, the said Reginald Ernest Hermans, from your duties as a member of the said Commission and hereby appoint you, the said Thomas Walton Smallfield, to be a member of the said Commission in the stead of the said Reginald Ernest Hermans:

And it is hereby declared that all acts and things done and decisions made by the said Commission or any of its members, in the exercise of its powers, before the issuing of these presents, shall be deemed to have been made and done by the said Commission as reconstituted by these presents and as if you, the said Thomas Walton Smallfield, had originally been appointed to be a member of the said Commission in the place and stead of the said Reginald Ernest Hermans:

And I hereby confirm the said Order in Council made on the 26th day of April 1982, save as modified by these presents:

Given in Executive Council under the hand of His Excellency the Governor-General this 21st day of June 1982.
