THE NEW ZEALAND GAZETTE
2045
of the male nude, and some cartoon illustrations. It is aimed
at the homosexual adult and generally presents a reasonably
balanced approach in its content."
Even so, the Police are concerned at the promotion of
homosexual conduct included in the magazine and in their
submission have recommended that the publication should
be classified as indecent.
In its submission the Venus Shop Ltd., made a general
statement which indicated that "it is important to note that
the shop at which these items were purchased is a shop
that caters for the adult population and entry is restricted
to those of 18 years or over." With reference to this edition
of Riding High, the Venus Shop Ltd. stated that "male homo-
sexuality is not a crime. Indecencies between males are a
crime . . . It is not unlawful for homosexuals to communi-
cate."
It would appear to the Tribunal that the two problem areas,
with reference to Riding High, Volume 8, is its availability
to the public, and closely related to this, the problem of
access to it by young persons. If Riding High is being sold
to the general public through bookshops then the Tribunal
would need to give consideration to classifying it indecent.
But, if the magazine is published for and supplied to sub-
scribers on a mailing list basis then it would appear that
the publication should be classified with an age restriction
only, as indecent in the hands of persons under the age of
18 years. This is a most difficult classification on which to
rule. Summing up all aspects, the Tribunal classifies the
magazine as indecent principally because the public good
requires it.
District Court Judge WILLIS, Chairman.
