PURSUANT to section 175 (3) and subject to sections 176 to 182 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council hereby authorises the Manukau City Council to reclaim an area of 2660 square metres, more or less, of Auckland Harbour Board endowment land at Kauri Point, Pahurehure Inlet, Manukau Harbour being part tidal lands adjoining Lot 1, D.P. 77476, situated in Block XIV, Otahuhu Survey District and being part certificate of title 9 B/1172 LTD and as more particularly shown on plan M.D. 16069, deposited in the office of the Ministry of Transport at Wellington.

WHEREAS:

1. The Auckland Harbour Board is the registered proprietor of an estate in fee simple in the land described in the Schedule hereto (hereinafter called the "land").

2. The land is an area of the Whau River bed Auckland, which has been reclaimed without the necessary approval in terms of section 175 and 178 of the Harbours Act 1950.

Now acting by and with the advice and consent of the Executive Council His Excellency the Governor-General acting pursuant to section 265 of the Harbours Act 1950, hereby validates the above-mentioned reclamation.

SCHEDULE

ALL that parcel of land in the North Auckland Land District containing 5975 square metres, more or less, being Lot 1 as shown on Scheme Plan D.P. 88216, M.D. 16050.
