The Charitable Trusts Act 1957—Notice of Application for Approval of a Scheme Under Part III of the Charitable Trusts Act 1957

NOTICE is hereby given that the Public Trustee as trustee of the will of William Hathaway, late of Stratford in New Zealand, farmer, deceased, and as solicitor for the vestry of Holy Trinity Parish, Stratford, has filed in the office of the High Court, at Wellington, an application for approval of a scheme extending or varying the powers of the Public Trustee in respect of the remaining one-third of the residuary estate of the above-named deceased, administered by the Public Trustee under the said will and extending or varying the powers of the vestry in respect of the accumulated income held by it, and received from time to time from the Public Trustee. Under the said will the said remaining one-third of the residuary estate, and the interest derived therefrom are to be paid to the vestry for the purpose of building a new Anglican Church in Stratford.

It has now become impossible and impracticable to use the funds held by the Public Trustee in the said residuary estate, and the accumulated income derived therefrom held by the vestry for the said purpose, because they are now both together totally inadequate. Under the scheme the Public Trustee will pay to the vestry the capital held by it, in terms of the said will, and the vestry will use the said capital, and also the accumulated income held by it, and derived from the said capital for the purpose of assisting to pay for the extensions recently made to the Holy Trinity Anglican Church in Stratford.

Copies of the application, the scheme and the report of the Attorney-General thereon may be inspected, free of charge, at the Office of the Registrar of the High Court, at

Wellington, or at the Office of the Pubic Trustee, 131–133 Lambton Quay, Wellington, or at the office of the District Public Trustee, Broadway North, Stratford. The date proposed for the hearing of the application is the 26th day of June 1981. Any person desiring to oppose the scheme is hereby required to give notice, of his or her intention to do so, to the Registrar of the High Court, at Wellington, and to the Public Trustee at Wellington, and to the vestry of Holy Trinity Parish, Stratford, and to the Attorney-General, not less than 7 clear days before that date.

Approval of Taxi Audible Warning Devices

PURSUANT to subclause (1) of regulation 88 of the Traffic Regulations 1976*, the Secretary for Transport hereby approves for the purposes of subclause (5) of regulation 69 of the said regulations, taxi audible warning devices of the make and type described in the Schedule hereto.

SCHEDULE

Taxi audible warning devices manufactured by Woodvale Audio Ltd. of Lower Hutt, and marked “29 Mk I Audio Alarm”.

Otago Raspberry Marketing Committee Election

PURSUANT to the Second Schedule to the Raspberry Marketing Regulations, notice is hereby given that the roll of those persons qualified to vote for the election of 2 producers’ representatives in the Southern Ward to the Otago Raspberry Marketing Committee will be open for inspection, during ordinary office hours at the following places, viz: Ministry of Agriculture and Fisheries, Head Office, Wellington, also at the offices of the Ministry of Agriculture and Fisheries, at Oamaru, Dunedin, Roxburgh, Alexandra, and at the office of A. P. Hayes (Secretary), 37a Thames Street, Oamaru.

The roll will be available for public inspection, for a period of 7 days from 24 May 1981, during which period any person may lodge with the Returning Officer an objection in writing under his hand to any entry on the roll.

Nomination forms may be obtained on application to any of the above offices or from the Returning Officer, Ministry of Agriculture and Fisheries, Dunedin. Nominations must be in the hands of the Returning Officer, not later than noon on the 11th day of July 1981.
