PUBLIC NOTICE

Notice is hereby given that the Nelson School of Music Trust Board has filed in the office of the High Court at Nelson, an application for approval of a scheme varying the terms of a bequest to the board. The bequest on the 19th April 1919, by the will of Phyllis Fell, late of Nelson, spinster, was of a “Testore” violin. The board propose the violin be sold and the proceeds applied as follows:

  1. To meeting the cost of repairs and restoration of the “Testore” violin.

  2. To purchase one violin of high quality, suitable for pupils of National Youth Orchestra or Grade 8 standard, to be available for use without charge to a student of the school.

  3. To purchase three violins of intermediate standard to be available for use without charge to students of the school.

  4. Any surplus funds to be invested in authorised investments and the income applied first as to one-half thereof, to increasing the number of scholarships for study at the school of the violin, and as to the other half to subsidising the school’s violin teaching tuition fees.

The grounds for the application are that it is expedient to give effect to the bequest because of the considerable value of the violin. The value is such that it is unwise to allow the instrument to be used for its original purpose.

Copies of the scheme and the report of the Attorney-General thereon, may be inspected free of charge at the office of the Registrar of the High Court, Nelson, and the office of the Nelson School of Music Trust Board, Nile Street, Nelson.

The date proposed for the hearing of the application is in the Nelson High Court, sessions commencing the 15th day of June 1981. Any person desiring to oppose the scheme is required to give written notice of his or her intention, to the Registrar of the High Court, at Nelson, to the Nelson School of Music Board of Trustees, and the Attorney-General, not less than 7 clear days before the 15th day of June 1981.
