Commerce Commission Decision and Loan Consents

1338
THE NEW ZEALAND GAZETTE
No. 58

By this decision the Commission—
(a) Revokes its approval, as contained in its decision No. 27, of the collective pricing agreements referred to in applications lodged by the New Zealand Stock and Station Agents Association and registered by this Commission as applications numbered 6 and 26 and the conditions to that approval and in substitution thereof;
(b) Approves the trade practice whereby the New Zealand Stock and Station Agents Association alone issues from time to time a maximum only scale of fees and charges for services to which the said applications refer, which approval shall be subject to the following conditions:
(i) That, where the maximum amounts allowed to be charged under any scale of fees and charges issued in terms of this approval are subject to control under any statute or regulations, the said scale of fees and charges, and any alteration to the scale of fees and charges, must comply with any relevant provisions of such control legislation.
(ii) That, where the maximum amounts allowed to be charged under any scale of fees and charges to which this approval refers, are not subject to control under any statute or regulations, any alteration to the scale of fees and charges must be submitted for prior approval by the Commerce Commission.
(iii) That any scale of fees and charges issued in terms of the approval be clearly headed to show that the prescribed fees and charges are the maximum which may be charged, and that lower fees or charges may be charged without the risk of the association applying sanctions of any kind.
(iv) That the current scales of fees and charges appended to this Decision are deemed to have been issued in terms of this approval, and shall be issued to each executive member of the association within 3 months of the date of this Decision.
(v) That each constituent member of the association shall within 6 months of the date of this Decision:
(a) Revoke any scale of fees and charges covering items in the scales appended hereto which have been issued by or on behalf of that constituent or which form part of its rules or regulations; and
(b) Revoke, or amend as necessary any rule, regulation or resolution which is in conflict with the foregoing conditions to this approval; and
(c) If any dispute arises within the said period as to whether (a) or (b) herein has been implemented the Examiner or the New Zealand Stock and Station Agents Association may bring the matter before the Commission to determine the dispute.
