Eyre County—Kaiapoi Borough Boundary Alteration Order 1981

At the Government House at Wellington this 30th day of March 1981

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL,

PURSUANT to the Local Government Act 1974, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order:

ORDER

  1. Title and commencement—(1) This order may be cited as the Eyre County-Kaiapoi Borough Boundary Alteration Order 1981.

(2) This order shall come into effect on the 1st day of April 1981.

  1. Boundaries of Eyre County and Kaiapoi Borough Altered—(1) The boundaries of the County of Eyre and the Borough of Kaiapoi shall be altered by excluding from the district of the County of Eyre and including in the district of the Borough of Kaiapoi the areas of land described in the First Schedule to this order.

(2) The boundaries of the Borough of Kaiapoi and the County of Eyre shall be altered by excluding from the district of the Borough of Kaiapoi and including in the district of the County of Eyre the area of land described in the Second Schedule to this order.

  1. Effect on Riding—The area of land described in the Second Schedule to this order shall form part of Eyreton Riding in the County of Eyre.

  2. Transitional Provisions—The Kaiapoi Borough Council in respect of the areas of land described in the First Schedule to this order, and the Eyre County Council in respect of the area of land described in the Second Schedule to this order:

(a) Shall have and may exercise and be responsible for all the powers, duties, acts of authority, and functions which were previously exercised, or which would have been so exercised, by the territorial authority from whose district the area is hereby excluded;

(b) Shall have and may exercise and be responsible for all liabilities, obligations, engagements, and contracts which previously were, or which would have been, the responsibility of the territorial authority from whose district the area is hereby excluded;

(c) Shall have and may exercise and be responsible for all actions, suits, and proceedings pending by or against, or which would have been the responsibility of, the territorial authority from whose district the area is hereby excluded;

(d) Shall succeed to the bylaws, which are in force and which are applicable to the authority’s altered circumstances and, until revoked or altered by such authority, every such bylaw shall remain in force in the area in which it was in force immediately before the alteration of boundaries; and every bylaw which cannot be restricted to the area shall be deemed inapplicable and revoked in respect of the area by the alteration of boundaries;

(e) Shall succeed to all rates or levies and other money payable to the territorial local authority from whose district the area is hereby excluded;

(f) Shall succeed to the valuation rolls, electoral rolls, and rate records in force in the area, and these shall remain in force in the area until such rolls or records are made for it and until that time Part IX of the Rating Act 1967 shall apply as if the enlarged district was the district of a special purpose authority and the areas from which it was formed were constituent districts.

  1. Vesting of Land—The corporation of the district of the Borough of Kaiapoi in respect of the areas of land described in the First Schedule to this order, and the corporation of the district of the County of Eyre in respect of the area of land described in the Second Schedule to this order, shall have vested in it, subject to all existing encumbrances, all land in the area or areas vested in the corporation of the district of the territorial local authority from whose district the area or areas is excluded.

  2. Mayor, Chairman, and Principal Administrative Officer—The Mayor and principal administrative officer of the Kaiapoi Borough Council shall exercise the duties, powers, and functions of the chairman and principal administrative officer of the Eyre County Council in respect of the areas of land described in the First Schedule to this order, and the chairman and principal administrative officer of the Eyre County Council shall exercise the duties, powers, and functions of the mayor and principal administrative officer of the Kaiapoi Borough Council in respect of the area of land described in the Second Schedule to this order.

  3. Creditors—Subject to section 37F of the Local Government Act 1974, the rights or interests of creditors of any district affected by the order shall not be affected.

  4. Rating—The system of rating in the areas referred to in the Schedules of this order shall continue to be the land value system.

FIRST SCHEDULE

ALL that area in the Canterbury Land District, Eyre County, containing 18.4320 hectares, more or less, bounded by a line commencing at the intersection of the northern side of Fuller Street with the western boundary of the Kaiapoi Borough, as described in New Zealand Gazette, 1951, page 950; thence westerly, generally, along the southern side of the main north railway and along a right line to and along the south-western side of another portion of the main north railway to a point in line with the western boundary of Lot 1, D.P. 16837; thence northerly, generally, along a right line being the production of the said western boundary of Lot 1, D.P. 16837, to the middle of the Kaiapoi River; thence north-westerly, generally, up the middle of the Kaiapoi River to the northern boundary of Eyre County as described in New Zealand Gazette, 1951, page 951, being the middle line of the old bed of the Kaiapoi River; thence easterly, generally, along the middle line of the old bed of the Kaiapoi River to a point in line with the original middle line of Revells Road; thence northerly, generally, along the production of the said middle line of Revells Road to the northern bank of the old bed of the Kaiapoi River; thence southerly, generally, along that bank to and along the western boundary of the Kaiapoi Borough as described in New Zealand Gazette, 1951, page 950, to the point of commencement.

Also all that area in the Canterbury Land District, Eyre County, containing 109.2240 hectares, more or less, bounded by a line commencing at the south-eastern corner of Lot 8, D.P. 40787, being a point on the south-eastern boundary of the Kaiapoi Borough as described in New Zealand Gazette, 1951, page 950; thence southerly, generally, along the production of the eastern boundary of Lot 8, D.P. 40787, to the middle of the Kaikainui Stream; thence south-easterly and south-westerly, generally, down the middle of the Kaikainui Stream to and up the middle of the Courtenay Northern Motorway; thence northerly, generally, along the eastern side of that motorway, to and along the southern, western, northern, and north-eastern boundaries of that part of Lot 2, D.P. 1575, containing 2.3562 hectares, and shown coloured orange on plan S.O. 11054, to and along the north-eastern boundary of another portion of Lot 2, D.P. 1575, containing 392 square metres, and shown coloured orange on plan S.O. 11054, to the north-western side of Coups Road; thence north-easterly, generally, along the north-western side of Coups Road to a point in line with the south-western boundary of part Lot 1, D.P. 22775; thence south-easterly, generally, along the production of the last-mentioned boundary to and along the south-western and southern boundaries of the Kaiapoi Borough as described in
