Commerce Act 1975—Notification of Bread Prices

PURSUANT to section 87 of the Commerce Act 1975, I Desmond James Gasson, being duly authorised in this behalf by the Secretary of Trade and Industry, hereby give the following notice.

NOTICE

1. This notice shall come into force on the 27th day of February 1981.

2. Every person engaged in the production and sale of loaves of bread which weigh not less than 225 grams is required:

(a) To furnish to the Secretary of Trade and Industry within seven (7) days of the date of the implementation of each and every increase in the selling price of bread, the particulars prescribed in Form I below in the manner provided therein;

(b) To furnish to the Secretary of Trade and Industry within seven (7) days of the date of any new variety of bread being offered for sale, the particulars prescribed in Form II below in the manner provided therein.

NOTES—

1. This notification is required to be forwarded within 7 days of the implementation of a price increase and is to be accompanied by all new price lists.

2. Notification is required only for increases in the price of bread weighing not less than 225 grams.

3. Notifications and price lists should be forwarded to the nearest office of the Department of Trade and Industry. Offices are located at Auckland, Wellington, Christchurch, and Dunedin.

4. The indication by a baker of a resale price for his bread is subject to the resale price maintenance provisions of the Commerce Act 1975 (section 28). The effect of that provision is:

(a) You may not indicate mandatory resale prices without the prior approval of the Commerce Commission to the issue of any such indication.

(b) You may indicate resale prices if they are suggested prices only, with resellers free to charge other prices provided that the Commerce Commission is officially notified of the arrangement by which resale prices are suggested and each price list issued contains:

(i) The full name of the wholesaler issuing the price list;

(ii) In bold type on the first page of each price list a statement to the following effect—

"Any resale price or margin or conditions of sale set out or indicated herein are suggestions only. Other prices may be charged and other conditions of sale may be imposed, in relation to the goods to which the price or margin or conditions of sale relate, without the risk of the issuer of this notice or the supplier of the goods applying sanctions of any kind."

(Approved forms for notifying the Commerce Commission of any arrangement under which resale prices are indicated may be obtained from the Commerce Commission or the Office of the Examiner of Commercial Practices.)
