HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Local Government Act 1974, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER
- Title and commencement—(1) This order may be cited as the Taupo Borough-Taupo County Boundary Alteration Order 1981.
(2) This order shall come into force on the 1st day of April 1982.

Boundaries of Taupo County and Taupo Borough Altered—The boundaries of the County of Taupo and the Borough of Taupo shall be altered by excluding from the County of Taupo and including in the Borough of Taupo the area of land described in the Schedule to this order (hereafter referred to in this order as “the said area”).

Transitional Provisions—The Taupo Borough Council in respect of the said area:
(a) Shall have and may exercise and be responsible for all the powers, duties, acts of authority, and functions which were previously exercised, or which would have been so exercised, by the Taupo County Council;
(b) Shall have and may exercise and be responsible for all liabilities, obligations, engagements, and contracts which previously were, or which would have been, the responsibility of the Taupo County Council;
(c) Shall have and may exercise and be responsible for all actions, suits, and proceedings pending by or against, or which would have been, the responsibility of the Taupo County Council;
(d) Shall succeed to the bylaws which are in force and which are applicable to the authority’s altered circumstances; and, until revoked or altered by the Taupo Borough Council, every such bylaw shall remain in force in the area in which it was in force immediately before the alteration of boundaries; and every bylaw which cannot be restricted to the area shall be deemed inapplicable and revoked in respect of the said area by the alteration of boundaries;
(e) Shall succeed to all rates or levies and other money payable to the Taupo County Council;
(f) Shall succeed to the valuation rolls, electoral rolls, and rate records in force in the said area, and these shall remain in force until such rolls or records are made by the Taupo Borough Council; and until that time Part IX of the Rating Act 1967 shall apply as if the district in which that area was included was the district of a special purpose authority and the areas from which it was formed were constituent districts.

Vesting of Land formerly vested in the Corporation of the District of Taupo County—The corporation of Taupo Borough shall, in respect of the said area, have vested in it, subject to all existing encumbrances, all land situated in that area that was previously vested in the corporation of Taupo County.

Mayor and Principal Administrative Officer—The mayor and principal administrative officer of the Taupo Borough Council shall exercise the duties, powers, and functions of the chairman and principal administrative officer of the Taupo County Council in respect of the said area.

Creditors—Subject to section 37F of the Local Government Act 1974, the rights or interests of creditors of any districts affected by the order shall not be affected.

Rating—The system of rating in the said area shall continue to be the land value system.
SCHEDULE
AREA TO BE EXCLUDED FROM THE TAUP0 COUNTY AND INCLUDED IN THE TAUP0 BOROUGH
All that area in the South Auckland Land District containing 1939 hectares, more or less, bounded by a line commencing at the easternmost point of Lot 1, D.P. S. 21311, being a point on the left bank of the Waikato River and proceeding in a south-westerly direction along that bank to and along the shore of Lake Taupo to a point, bearing 165° 00', south-east of the intersection of the north-eastern corner of a public road (as defined on ML 16214) with Acacia Bay Road; thence in a north-westerly direction along that right line to the said intersection; thence in a north-easterly direction along the south-eastern side of Acacia Bay Road to the production of the north-eastern boundary to Rangatira B615 Block; thence north-westerly to and along that boundary to the northernmost corner of the said Block; thence south-westerly along the north-western boundary of the said Block to the north-eastern boundary of part Rangatira 8A Block; thence north-westerly along that boundary to an angle, bearing 50° 02', 17.08 metres (34.9 links) from ITXI, shown on ML 19097; thence in a north-easterly direction along a right line to the westernmost point of Rangatira Number 5 Block, along the north-western boundary of the said Block to the northernmost point, and along another right line to an angle on the western side of Poihipi Road opposite ITXV, shown on S.O. 41900; thence in an easterly direction along a right line to boundary peg XXIVC, shown on S.O. 44183, on the eastern side of State Highway No. 1; thence in a north-easterly direction along the said eastern side to the intersection with the right bank of the Waipuwerawera Stream; thence in a south-easterly direction along that right bank to the intersection with the left bank of the Waikato River, along a right line to the westernmost point of Section 2, Block XIV, Taitua Survey District, along the south-western boundary of that Section to its southernmost point, along another right line to the south-western corner of Lot 1, D.P. S. 28936, on the northern side of Spa Road, once again along another right line to the most north-eastern corner of Section 320, Block II, Tauranga Survey District, and again along a right line to the north-eastern corner of Part Tauranga Middle 4A2 Block; thence in a generally southerly direction along the generally eastern and the south-eastern boundaries of the said 4A2 Block, shown on ML 20427, to and along the north-western boundary of Section 19, Block III, Tauranga Survey District, to the westernmost corner of the said Section 19; thence south-westerly along a right line to Transmission Line Pylon Number 565 (co-ordinates 593594.16 mN, 269175.14 mE), another right line to the southernmost corner of the Taupo Borough (Gazette, 1969, page 787), being a point on the production of the south-eastern boundary of the former Section 1, Block VI, Tauranga Survey District, in line with the north-eastern boundary of part Section 34, Block VI, Tauranga Survey District, along another right line to Trig F, along another right line to a boundary peg on State Highway No. 1 (bearing 312° 07', 53.96 metres from ITXXI), as shown on S.O. 45642, once again along another right line to the intersection of the north-eastern corner of a public road and part Section 120, Town of Tauranga, along the south-eastern boundary of the said Section to the eastern shore of Lake Taupo; thence generally in a north-easterly direction along that eastern shore to a point on the production of the north-eastern boundary of part Section 34, Block VI, Tauranga Survey District; thence south-easterly to and along that boundary and its production to a point in line with the south-eastern boundary of the former Section 1, Block VI, Tauranga Survey District; thence north-easterly to and along the said former Section 1 of the south-eastern boundary of Lot 89, D.P. 33323, the eastern end of Shepherd Road to its easternmost point; thence generally north-easterly along the south-western and south-eastern boundaries of Section 51, Block VI, Tauranga Survey District, to the easternmost point of the said Section; thence northerly along a right line to the south-eastern production of the northern boundary of a portion of closed road, for a distance of 45.10 metres (224.2 links), being a former road angle, and more particularly shown on S.O. 42902; thence westerly along that production to and along that northern boundary of the said closed road to the western boundary of part Tauranga Middle Number 1 Block and that last-mentioned boundary produced to an angle on the northern side of a portion of closed road, shown on S.O. 44926, along a right line to the easternmost corner of Section 117, Block II, Tauranga Survey District; thence generally northerly along a series of right lines crossing part Tauranga Middle Number 1 Block, bearing 13° 33' 10', 101.39 metres (504.0 links), as shown on S.O. Plan 43371, 295° 57', 67.16 metres (333.86 links); 341° 21', 143.74 metres (714.52 links) and 6° 22' 20", 56.62 metres (281.44 links), to peg XXIA, as shown on S.O. Plan 40608; thence north-westerly on a bearing 323° 26' 20" to a point on the eastern side of Miro Street; thence generally northerly along that eastern side and the south-eastern side of Tauranga Road to a road angle opposite the south-eastern point of part Section 308, Block II, Tauranga Survey District, as shown on S.O. 45249; thence northerly along a right line to and along the north-eastern boundary of the said part Section then south-western and western boundaries of Section 320, Block II,
