Liquor Licensing Notices

Mr Barnett objected that the Corporation could not properly deal with such matters which involved arguments about facts and incidents and the credibility of evidence without having given him a hearing.

We acknowledge the difficulties the Corporation has in dealing with credibility and merely comment that there will be occasions when the Corporation ought to consider a committee of the board meeting the complainant person to person and putting to him the responses of the staff of his complaints.

It is not for the Tribunal however to lay down the procedures of the Corporation but to deal with the outcome of the complaint by the Corporation.

That we do by making the following findings:

The complainant was not unfairly treated in the preparations leading up to the interview.

The programme itself breached the standards as set out in paragraphs 1, 2, 3 and 4 above. The programme in these respects failed to meet the standards of accurate and impartial presentation of news in accordance with the recognised standards of objective journalism.

In all other respects, Mr Barnett's allegations and complaints have not been proved.

The complaint is therefore upheld in part.

Co-opted Members—

Messrs Ell and Gardiner were co-opted as persons whose qualifications and experience were likely to be of assistance to the Tribunal in dealing with the complaint. They took part in the hearing and the deliberations of the Tribunal but the decision, in accordance with the Act, is that of the permanent members.

Dated this 15th day of October 1981.

For the Tribunal:

B. H. SLANE, Chairman.
