PURSUANT to section 15 of the Electoral Act 1956, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and on the nomination of the House of Representatives, hereby appoints Peter Barrie Leay, Esquire, of Wellington (who is nominated to represent the Government), and
John Philip Lcwin, Esquire, of Wellington (who is nominated to represent the Opposition)
as the unofficial members of the Representation Commission.

Waipawa District - Waipukurau District Boundary Alteration Order 1981

THE RIGHT HON. D. MACINTYRE PRESIDING IN COUNCIL
PURSUANT to the Local Government Act 1974, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order:
O R D E R
- Title and commencement—(1) This order may be cited as the Waipawa District - Waipukurau District Boundary Alteration Order 1981.
(2) This order shall come into force on the 31st day of October 1981.
- Boundaries of Waipawa District and Waipukurau District Altered—The boundaries of the District of Waipawa and the District of Waipukurau shall be altered by:
(a) Excluding from the District of Waipawa and including in the District of Waipukurau the areas described in the First Schedule to this order; and
(b) Excluding from the District of Waipukurau and including in the District of Waipawa the area described in the Second Schedule to this order.

Ridings—The area firstly described in the First Schedule to this order shall form part of the Waipukurau Riding in the District of Waipukurau and the area secondly described in the First Schedule to this order shall form part of the Patangata Riding in the District of Waipukurau; and the area described in the Second Schedule to this order shall form part of the Onga Riding in the District of Waipawa.

Transitional Provisions—The Waipukurau District Council, in respect of the areas described in the First Schedule to this order, and the Waipawa District Council, in respect of the area described in the Second Schedule to this order:
(a) Shall have and may exercise and be responsible for all the powers, duties, acts of authority, and functions which were previously exercised, or which would have been so exercised, by the territorial authority from whose district the area or areas are hereby excluded;
(b) Shall have and may exercise and be responsible for all liabilities, obligations, engagements, and contracts which previously were, or which would have been, the responsibility of the territorial authority from whose district the area or areas are hereby excluded;
(c) Shall have and may exercise and be responsible for all actions, suits, and proceedings pending by or against, or which would have been the responsibility of, the territorial authority from whose district the area or areas are hereby excluded;
(d) Shall succeed to the bylaws which are in force and which are applicable to the authority’s altered circumstances and, until revoked or altered by such authority, every such bylaw shall remain in force in the area in which it was in force immediately before the alteration of boundaries; and every bylaw which cannot be restricted to the area shall be deemed inapplicable and revoked in respect of the area by the alteration of boundaries;
(e) Shall succeed to all rates or levies and other money payable to the territorial authority from whose district the area or areas are hereby excluded;
(f) Shall succeed to the valuation rolls, electoral rolls, and rate records in force until such rolls or records are made for it and until that time Part IX of the Rating Act 1967 shall apply as if the district in which that area or those areas were included was the district of a special purpose authority and the areas from which it was formed were constituent districts.

Vesting of Land—The corporation of the District of Waipukurau in respect of the areas described in the First Schedule to this order, and the corporation of the District of Waipawa in respect of the area described in the Second Schedule to this order, shall have vested in it, subject to all existing encumbrances, all land in the area or areas vested in the corporation of the district of the territorial authority from whose district the area or areas are excluded.

Chairman and Principal Administrative Officer—The chairman and principal administrative officer of the Waipukurau District Council shall exercise the duties, powers, and functions of the chairman and principal administrative officer of the Waipawa District Council in respect of the areas described in the First Schedule to this order, and the chairman and principal administrative officer of the Waipawa District Council shall exercise the duties, powers, and functions of the chairman and principal administrative officer of the Waipukurau District Council in respect of the area described in the Second Schedule to this order.

Creditors—Subject to section 37r of the Local Government Act 1974, the rights or interests of creditors of any district affected by the order shall not be affected.

Rating—The system of rating in the areas described in the First and Second Schedules to this order shall continue to be the land value system.
FIRST SCHEDULE
Areas to be Included in Waipukurau District
FIRSTLY, all that area in the Hawke’s Bay Land District bounded by a line commencing at a point being the middle of the Tukituki River on the eastern side of the Palmerston North-Gisborne Railway in Block XIV, Waipukurau Survey District; thence southerly along that side to the northern boundary of Waipukurau 30N Block; thence easterly along that boundary to the eastern boundary of part Lot 1, D.P. 1667; thence northerly along the production of the last mentioned boundary to the middle of the Tukituki River; thence up the middle of that river to the point of commencement.
Secondly, all that area in the Hawke’s Bay Land District bounded by a line commencing at a point being the intersection of the middle of the old Waipawa Riverbed with the western boundary of Lot 2, D.P. 15798 in Block XII, Waipukurau Survey District; thence northerly generally up the western boundary of the said Lot 2 and the western boundary of Lot 1, D.P. 15798 and its production to the middle of Homewood Road; thence southeasterly along the middle of that road to its intersection with the middle of the old Waipawa Riverbed; thence up the middle of the said old Riverbed to the point of commencement.
SECOND SCHEDULE
Area to be Included in Waipawa District
ALL that area in the Hawke’s Bay Land District bounded by a line commencing at a point being the middle of the confluence of the Tukituki and Waipawa Rivers in Block XVI, Waipukurau Survey District, and proceeding northeasterly down the middle of the old Waipawa Riverbed to its intersection with the western boundary of Lot 2, D.P. 15798; thence southerly down the western boundary of the said Lot 2 across a road to and again down the said western boundary to the northern side of Pourerere Road; thence westerly along that roadside to its intersection with the production of the north-western side of Walkers Road; thence south-westerly to and along that roadside and its production to the middle of the Tukituki River; thence up the middle of that river to the point of commencement.
