Declaring Land Taken, Subject to Certain Encumbrances, for a State Primary School in Block XII, Waiwera Survey District, Rodney County
PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works and Development hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the Schedule hereto is hereby taken, subject to the fencing agreements contained in transfers 478405, 108588.2, and 061320.3, and to the building line restriction contained in 267192.1, for a State primary school, from and after the 3rd day of July 1980.

Declaring Land and Easements Over Land Taken for Electric Works in the City of Hastings
PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works and Development hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for electric works, and shall vest in the Hawke’s Bay Electric Power Board, and an easement in gross (right of way) is hereby taken for electric works, vesting in the Hawke’s Bay Electric Power Board the full, free, uninterrupted, and unrestricted right, liberty, and privilege of the Hawke’s Bay Electric Power Board, its servants, tenants, agents, workmen, licencees, and invitees (in common with the owner, its tenants, and other persons lawfully entitled so to do), from time to time and at all times by day and by night to go, pass, and repass with or without vehicles, motor vehicles, machinery and implements of any kind, over and along the land described in the Second Schedule hereto, provided that the Hawke’s Bay Electric Power Board shall erect a standard lamp for the purpose of lighting the said land described in the Second Schedule hereto and shall be responsible for the maintenance thereof and for the cost of the electric power used by the said lamp, and an easement in gross (underground power cable) is hereby taken for electric works over the land described in the Third Schedule hereto, vesting in the Hawke’s Bay Electric Power Board the rights to lay underground electric power cables, to maintain and replace cables, mains, and other appliances as may be considered necessary, for such purposes to excavate the land described in the Third Schedule hereto together with the right for the Hawke’s Bay Electric Power Board to enter by its servants, agents, contractors, and workmen, with or without tools and appliances as may be considered necessary, the land described in the Fourth Schedule hereto provided that (1) before entering upon or excavating the said land described in the Third and Fourth Schedules hereto the Hawke’s Bay Electric Power Board shall, except in cases of emergency, first give the owner of the said land reasonable notice and shall then carry out such entry and work as expeditiously and with the least interruption to or interference with the business of the said owner after taking into account the wishes of the said owner as practicable and if such work nevertheless results in loss, damage, or inconvenience to the owner, compensation shall be payable by the Hawke’s Bay Electric Power Board to the said owner for such loss, damage, or inconvenience including loss of profit to be agreed upon between the Hawke’s Bay Electric Power Board and the said owner, or failing agreement by arbitration pursuant to the provisions of the Arbitration Act 1908 and amendments and this clause, shall be deemed to be a submission to arbitration within the meaning of the said Act; in the case of an emergency the Hawke’s Bay Electric Power Board shall give the said owner notice setting forward the nature of such entry and work as soon as possible after the happening of the event rendering such urgent entry and work necessary; (2) in the event of it being necessary to alter the depth of line of the ducts contained in the underground cables caused by any future building construction carried out by the said owner, the cost of making such alterations to the level or line of the said ducts shall be met by the Hawke’s Bay Electric Power Board; (3) in the event of any future building construction by the said owner the Hawke’s Bay Electric Power Board will meet the extra cost the said owner may incur in accommodating the ducts containing the underground cables in the design, planning, and erection of the future building construction.
