Notice of Intention to Take Land, and a Water Supply Easement over Land, for Waterworks, in Block II Whakamaru Survey District, Taupo County

NOTICE is hereby given that it is proposed, under the provisions of the Public Works Act 1928, to take for waterworks the land described in the First Schedule hereto, and the water supply easement described in the Second Schedule hereto over the land described in the Third Schedule hereto, to be appurtenant to the land described in the Fourth Schedule hereto, such land and easement to be used for water supply purposes; and notice is hereby further given that the plan of the land, and the easement so required to be taken, is deposited in the Post Office at Mangakino, and is there open for inspection; that all persons directly affected by the taking of the said land and the easement over land should, if they have any objection to the taking of the said land and easement over land, not being an objection to the amount or payment of compensation, make a written objection and send it within 40 days after the first publication of this notice to the Planning Tribunal at Wellington; and that, if any objection is made in accordance with this notice, a public hearing of the objection will be held, unless the objector otherwise requires, and each objector will be advised of the time and place of the hearing.

Description of Water Supply Easement

The full, free, uninterrupted and unrestricted right, liberty, licence and authority in perpetuity for Her Majesty the Queen to enter upon the said land by her agents, workmen, and servants with or without any necessary vehicles, instruments, and appliances for the purpose to lay, place, construct, reconstruct, cleanse, repair and maintain a line of pipes on, along, under, or over the said land to the dominant tenement described in the Fourth Schedule hereto; and the full, free, uninterrupted, and unrestricted right, liberty, and privilege to convey water along that line of pipes in a free and unimpeded flow (except when the flow is halted for any reasonable period necessary for essential repairs), and in any quantity.
