Commerce Act 1975

  1. By letter dated 17 December 1979 the Minister of Trade and Industry has required the Commerce Commission to inquire, pursuant to section 82 (7) of the Act, and report to him on the advisability of removing certain items which are at present contained in the Positive List of Controlled Goods and Services 1977. These items are detailed in the Schedule at the end of this notice. A copy of the full text of the Minister's letter is available on application to the Commission.

  2. The Minister has asked that the reports of the Commission cover in particular:

(a) whether price control in terms of section 82 of the Act should be continued; or

(b) whether price restraint in terms of section 83 would be warranted if the goods were removed from the Positive List; or

(c) as an alternative to (a) and (b) whether any other action contemplated in section 66 of the Act may be appropriate;

(d) such other recommendations as the Commission thinks fit.

In addition the Minister mentioned that in respect of building boards there are a number of collective pricing arrangements that may affect the Commission's consideration of whether the goods should be removed from price control. He understands that the Examiner of Commercial Practices will be reporting to the Commission on these so that it may if it wishes consider jointly the trade practices and the pricing aspects of the products.

  1. The Minister has asked that reports be sent to him on each item after the particular inquiry is completed. All reports have been requested by 30 June 1980. Should the need arise the Minister expressed himself willing to extend this date.
