A PROCLAMATION

PURSUANT to subsection (6) of section 5 of the Education Lands Act 1949, I, The Right Honourable Sir Keith Jacka Holyoake, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the Schedule hereto, being an area vested in the Hawke’s Bay Education Board as a site for a school, shall be vested in Her Majesty the Queen, freed and discharged from every educational trust affecting the same, but subject to all leases, encumbrances, liens, or easements affecting the same at the date hereof.

SCHEDULE

HAWKE’S BAY LAND DISTRICT—WOODVILLE COUNTY

3035 square metres, more or less, being Lot 2, D.P. 9146 (formerly Lot 2, D.P. 1671), situated in Block I, Woodville Survey District. All certificate of title C2-78. Appurtenant hereto are water and pipeline rights created by T. 132388.

Given under the hand of His Excellency the Governor-General, and issued under the Seal of New Zealand, this 21st day of February 1980.

Southland County—Winton Borough Boundary Alteration Order 1980

ORDER IN COUNCIL

At the Government Buildings at Wellington this 17th day of March 1980

Present:

THE RIGHT HON. R. D. MULDOON PRESIDING IN COUNCIL

PURSUANT to the Local Government Act 1974, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. Title and commencement—(1) This order may be cited as the Southland County—Winton Borough Boundary Alteration Order 1980.

(2) This order shall come into effect on the 1st day of April 1980.

  1. Boundaries of Southland County and Winton Borough Altered—The boundaries of Southland County and Winton Borough shall be altered by excluding from the district of Southland County and including in the district of Winton Borough the areas of land described in the Schedule to this order.

  2. Transitional Provisions—The Winton Borough Council in respect of the areas described in the Schedule to this order:

(a) Shall have and may exercise and be responsible for all the powers, duties, acts of authority, and functions which were previously exercised, or which would have been so exercised, by the Southland County Council;

(b) Shall have and may exercise and be responsible for all liabilities, obligations, engagements, and contracts which previously were, or which would have been, the responsibility of the Southland County Council;

(c) Shall have and may exercise and be responsible for all actions, suits, and proceedings pending by or against, or which would have been the responsibility of, the Southland County Council;

(d) Shall succeed to the bylaws which are in force and which are applicable to its altered circumstances; and, until revoked or altered by the Winton Borough Council, every such bylaw shall remain in force in the area in which it was in force immediately before the alteration of boundaries; and every bylaw which cannot be restricted to that area shall be deemed inapplicable and revoked in respect of that area by the alteration of boundaries;

(e) Shall succeed to all rates or levies and other money payable to the Southland County Council;

(f) Shall succeed to the valuation rolls, electoral rolls, and rate records in force in the areas, and these shall remain in force until such rolls or records are made, by the Winton Borough Council; and until that time part IX of the Rating Act 1967 shall apply as if the district in which the areas were
