BEFORE THE INDECENT PUBLICATIONS TRIBUNAL

Judge W. M. Willis (chairman).
Mesdames L. Edmond, H. B. Dick, L. P. Nikera.
Mr J. V. B. McLinden.

Hearing: 22 July 1980.

Appearances: Mr P. E. Leloir for Comptroller of Customs. No Appearance for Importer, Miss P. M. Bartlett.

Decision

These five paper-back books were imported privately and as forfeiture was disputed by the importer, the books were referred by the Comptroller for classification. The Tribunal has been informed that the books were imported under a false name β€œJ. Smith”.

The books are all homosexual stories of no literary or artistic merit and are explicit in explaining the activities of the characters. In the Tribunal's view there is a plain tendency to corrupt. The language is coarse and obscene and there is a distinct dishonesty of purpose in each book. They deal with prurient and lewd aspects of sex. There is no redeeming feature in any of the books which the public interest and the public good require should be classified indecent.

What has interested the Tribunal is the fact that the books were imported under a false name, that the importer disputed forfeiture of what are clearly indecent publications and that having disputed the forfeiture made no attempt to have her views put forward before the Tribunal.

The Tribunal classifies all the books as indecent.

Dated at Wellington this 25th day of August 1980.

Judge W. M. WILLIS, Chairman.
