Reapportioning Representation of the Marlborough Catchment Board

ORDER IN COUNCIL

At the Government Buildings at Wellington this 22nd day of January 1980

Present:

THE RIGHT HON. R. D. MULDOON PRESIDING IN COUNCIL

PURSUANT to the Soil Conservation and Rivers Control Act 1941, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby further amends the Marlborough Catchment District Order 1970* as amended by Order in Council dated 22 July 1974† by deleting paragraph 3 and substituting the new paragraph 3 shown in the Schedule hereto.

This Order in Council shall come into effect on the 11th day of October 1980.

SCHEDULE

3. Constitution of the Board—The Marlborough Catchment Board shall consist of 6 non-elective members and 10 elective members with representation of such elective members being as follows.

David Duncan Webster of Christchurch, an officer of the Department of Lands and Survey,

to be a member of the North Canterbury Catchment Board for a period of 3 years from the date of this appointment.

The East Coast Bays City Council Foreshore Control Order 1980

ORDER IN COUNCIL

At the Government Buildings at Wellington this 4th day of February 1980

Present:

THE RIGHT HON. R. D. MULDOON PRESIDING IN COUNCIL

PURSUANT to section 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

O R D E R

  1. (a) This order may be cited as the East Coast Bays City Council Foreshore Control Order 1980.

(b) This order shall come into force on the date of its publication in the Gazette.

  1. In this order:

“the Act” means the Harbours Act 1950;

“the Council” means the East Coast Bays City Council;

“foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tide;

“Minister” means the Minister of Transport and includes any officer, person, or authority acting by or under the direction or authority of the Minister.

  1. There is hereby granted to the Council for a period of 21 years from the commencement of this order, subject to the provisions of section 165 of the Act and to the conditions specified in the Second Schedule to this order control of the foreshore as described in the First Schedule to this order.

FIRST SCHEDULE

ALL that portion of foreshore fronting the City of East Coast Bays but excluding that area of foreshore occupied by the Murrays Bay Wharf as shown on plan M.D. 4539; the said area as more particularly shown on plan numbered M.D. 15985 and deposited in the office of the Ministry of Transport at Wellington.
