THE CHARITABLE TRUSTS ACT 1957
NOTICE OF APPLICATION FOR APPROVAL OF A SCHEME UNDER PART III OF THE CHARITABLE TRUSTS ACT 1957
Notice is hereby given that the Presbyterian Church Property Trustees, a body corporate under the provisions of the Presbyterian Church Property Act 1885, have filed in the office of the Supreme Court at Napier an application for approval of a scheme in respect of a bequest paid to the said Presbyterian Church Property Trustees under the provisions of the last Will and Testament of the late James Anderson, deceased, which Will was dated the 16th day of April 1898 of which the principal sum now amounts to $5,935.13 and the accumulated unexpended income as at the 30th June 1978 amounted to $16,398. The scheme provides for the said accumulated income and future income to be applied:
(a) For distribution to such person or persons residing within the parish of or belonging to the congregation of Saint Paul’s Presbyterian Church, Napier, as the Kirk Session of Saint Paul’s Presbyterian Church, Napier, may consider to be in need of charitable assistance;
(b) To pay to the Presbyterian Social Service Association of Hawke’s Bay and Poverty Bay Incorporated such sum or sums as the Kirk Session of Saint Paul’s Presbyterian Church, Napier, may think fit to be expended by the said association for the general or any special purpose or purposes of such association;
upon the grounds that the income which has accrued and which will accrue is more than is necessary for the purpose of the original bequest, and upon the further grounds that the carrying out of the trust could be facilitated by extending the powers of the trustees. The trustees believe that the extended purposes of the scheme would best give expression to the intention of the above-named James Anderson.
Copies of the scheme and the report of the Attorney-General thereon may be inspected free of charge at the office of the Registrar of the Supreme Court, Napier, and at the offices of the Presbyterian Church Property Trustees, Dalmuir House, 114 The Terrace, Wellington.
The date proposed for the hearing of the application is the 21st day of November 1979. Any person desiring to oppose the scheme is hereby required to give written notice of his intention to the Registrar of the Supreme Court at Napier and to the Presbyterian Church Property Trustees, and to the Attorney-General, not less than seven clear days before that date.
L. H. CHISHOLM,
Solicitor to the Presbyterian Church Property Trustees.
