The Water Recreation (Urenui River) Notice 1979—Clifton County Council

PURSUANT to the Water Recreation Regulations 1979*, I, Alexander King Ewing of the Ministry of Transport, in exercise of powers delegated by the Minister of Transport hereby give the following notice.

NOTICE

  1. (a) This notice may be cited as the Water Recreation (Urenui River) Notice 1979.

(b) This notice shall come into force on the date of its publication in the Gazette and shall remain in force until revoked by further notice in the Gazette.

  1. Subject to the conditions set forth in the Second Schedule hereto, the area described in the First Schedule hereto shall be reserved as an area for water skiing activities.

FIRST SCHEDULE

ALL that area of water in the Urenui River bounded on the sides by right lines and between a line across the river at the suspension foot bridge being in line with the common side boundaries of Lot 3, Deposited Plan 7373, and part Section 17, Block III, Waitara Survey District, and a line across the river approximately 445 metres downstream being in line with the common side boundaries of Section 8, S.O. 9491, Urenui Town Belt, and part Section 17, Block III, Waitara Survey District, excepting thereout all that water 7.5 metres from the edge of the water at all stages of the tide on the Urenui Domain Road side of the river, as more particularly shown on plan M.D. 15941, and deposited in the office of the Ministry of Transport at Wellington.

SECOND SCHEDULE

  1. The area described in the First Schedule to this notice shall be marked as follows: One 2.5 metre post painted with 300 mm bright orange and black bands shall be erected on high-water mark on both banks of the Urenui River at the upstream and downstream limits of the area described in the First Schedule hereto.

  2. On each side of each post, sited on high-water mark there shall be fastened in line with the sides of the water ski area a notice measuring not less than 800 mm by 600 mm painted bright orange with black lettering in the following form:

“Water Recreation Regulations 1979
Area where small craft and water skiers may travel at speeds greater than 5 knots.”

  1. Notwithstanding any other provisions of this notice, no person who is permitted by any such provision to propel or navigate a small craft at a speed through the water exceeding 5 knots shall do so in any manner that is likely to endanger or unduly annoy any person who is in, on, or using the water, or fishing or undertaking any recreational activity in the vicinity of the small craft.

  2. All persons in charge of a vessel or when water skiing shall adhere to and keep the provisions of all other acts and regulations not specifically exempted by this notice.

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and in the matter of an application by the Secretary for Justice in respect of Gang Girls and Goodbye.

Goodbye

This book has been submitted to the Tribunal by the Secretary for Justice.

The book, a hard cover publication, is a novel published in the United Kingdom by a reputable publisher in 1977. The single copy submitted to the Tribunal is from the Wellington Public Library which has been on general issue for more than a year.

The Tribunal was told that the Customs Department has taken a view of the book which has prevented importation for distribution by wholesalers. The Secretary, therefore seeks classification of the book by the Tribunal.

The book is in substance a murder mystery which deals in realistic fashion with a police investigation. There is a considerable amount of sex in the book both implicit and explicit.

Having regard to all the matters to be considered by the Tribunal under section 11 of the Act we consider that there is an overall balance in the book which outweighs those parts which in isolation are indecent.

The Tribunal classifies this book as not indecent.

Gang Girls

The Secretary for Justice, in an infrequent exercise of his rights under the Act, has submitted this paper back to the Tribunal. In seeking a classification, the submissions made on his behalf, raise, unusually, the issue of violence rather than sex or crime.

The book is a novel set in the Manchester district which deals with the activities of four girls, associated by chance, who set out on a course of violence and crime. In the end, in the best tradition, retribution is exacted from the criminals.

There is a considerable amount of violence depicted in the book as the four girls, without motive, carry on a short career of indiscriminate and aimless bashing and theft. What is unusual about this book is that the principal characters are girls rather than the gangsters, bikies, or bully boys usual in books, films, and television.

The violence so depicted and described is neither so explicit nor so offensive as to be contrary to what the Tribunal considers to be the current standard of the community. There is not, in this book, in our view, any mischievous or immoral tendency and while there may be little literary merit there is an honest purpose overall and no likelihood of corruption or injurious effect on those who may read it.

The Tribunal therefore classifies this book as not indecent.

Hop Marketing Committee Election

PURSUANT to clause II of the Schedule to the Hop Marketing Regulations 1939, notice is hereby given that the roll of those persons qualified to vote for the election of five producers’ representatives on the Hop Marketing Committee will be open for inspection during ordinary office hours at the following places, viz.: Ministry of Agriculture and Fisheries, Head Office, Wellington, and at Nelson; also at the following post offices, viz.: Motueka, Upper Moutere, Wakefield, and Nelson.

The roll will be available for public inspection for a period of 7 days from 18 July 1979.

Nomination forms may be obtained on application to any of the above offices or from the returning officer, Ministry of Agriculture and Fisheries, Nelson.

Nominations must be in the hands of the returning officer not later than noon on 12 September 1979.
