ORDER
- (a) This order may be cited as the Dannevirke County Council Foreshore Control Order 1979.
(b) This order shall come into force on the date of its publication in the Gazette.
- In this order:
“the Act” means the Harbours Act 1950;
“the Council” means the Dannevirke County Council;
“foreshore” means such parts of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tide;
“Minister” means the Minister of Transport and includes any officer, person or authority acting by or under the direction or authority of the Minister.
- There is hereby granted to the council for a period of 21 years from the commencement of this order subject to the provisions of section 165 of the Act and to the conditions specified in the Second Schedule to this order, the control of the foreshore as described in the First Schedule to this order.
FIRST SCHEDULE
ALL that area of foreshore adjacent to Dannevirke County commencing at a point on the southern side of Akito River opposite the northern boundary of section 25, thence southwards to a point opposite the west end of the land zoned residential as more particularly shown coloured yellow and red on plan M.D. 15942 and deposited in the office of the Ministry of Transport at Wellington.
SECOND SCHEDULE
CONDITIONS

Her Majesty or the Governor-General and all officers in the Government service acting in the execution of their duty shall, at all times, have free ingress, passage, and egress into, over, and out of the foreshore described in the First Schedule to this order without payment.

Nothing herein contained shall authorise the council to do, or cause to be done, anything repugnant to or inconsistent with any law relating to the customs, or with any regulation of the Minister of Customs, or with any provision of the Harbours Act 1950, or its amendments, or any regulations made thereunder that are, or may hereafter be, in force.

The rights, powers, and privileges conferred by this Order in Council shall not apply to those portions of the foreshore required for securing the shore ends of any telegraph cable that are at present or may be at any time laid down within the said area of foreshore.

The council may enclose any part or parts of the foreshore described in the First Schedule hereto for the purpose of holding athletic sports or games, and may, by bylaw, fix a charge for admission to such enclosed part or parts; provided that the total number of days on which such enclosures are made shall not exceed 6 in any one year.

Nothing herein contained shall authorise the council to remove or cause to be removed, any stone, sand, shingle, or shells without the consent of the Minister first being obtained.

The said rights, powers, and privileges may be at any time resumed by the Governor-General, without payment of any compensation whatever, on giving to the Council 6 calendar months’ notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at or posted to the last known address of the council known in New Zealand.

PURSUANT to section 4 of the Disabled Persons Employment Promotion Act 1960, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER

Title—This order may be cited as the New Zealand Society for the Intellectually Handicapped (Incorporated), Southland Branch Order 1979.

Exemption—The New Zealand Society for the Intellectually Handicapped (Incorporated), Southland Branch, an organisation approved by the Minister of Labour under section 3 of the Disabled Persons Employment Promotion Act 1960, is hereby granted exemption, in respect of its sheltered workshop at 28 Onslow Street, Invercargill, from—
(a) All the provisions of every award and agreement that would otherwise apply to person employed in that workshop; and
(b) The Annual Holidays Act 1944, the Minimum Wage Act 1945, and section 34 of the Factories Act 1946.
- Revocation—The Intellectually Handicapped Children’s Society (Incorporated), Southland Branch Order 1966* is hereby revoked.

PURSUANT to section 35 of the Defence Act 1971, His Excellency the Governor-General has approved the following appointments, promotions, extensions, transfers, resignations, and retirements of officers of the New Zealand Naval Forces.
