Vesting a Reserve in the Franklin County Council

PURSUANT to the Reserves Act 1977, the Minister of Lands hereby vests the reserve, described in the Schedule hereto, in the Franklin County Council in trust for a site for a town hall.

Consent to the Generation of Electricity by Anderson Brothers of Mount Patriarch, Blenheim, by the use of Water

PURSUANT to the Electricity Act 1968, the Minister of Energy hereby consents to the generation of electricity by Anderson Brothers of Mount Patriarch, Blenheim, by the use of water, subject to the following conditions.

CONDITIONS

  1. The conditions directed by the Water Power Regulations 1934, to be implied in every licence to use water for the purpose of generating or storing electricity, shall be deemed to be conditions of this consent as if it were such a licence.

  2. This consent is subject to compliance with the Water Power Regulations 1934, the Electrical Supply Regulations 1976, the Electrical Wiring Regulations 1976, the Radio Interference Regulations 1958, and all regulations hereafter made in amendment of or in substitution for any of those regulations, as if in the case of the Water Power Regulations 1934 it were a licence under the Public Works Act 1928 to use water for the purpose of generating electricity as well as a consent under the Electricity Act 1968, to generate electricity by the use of water.

  3. The generation of electricity by the use of water, pursuant to this consent, shall be carried out by means of the works described in the Schedule hereto.

  4. This consent shall, unless it is sooner lawfully determined, continue in force until the 31st day of March 2000.

  5. This consent confers no rights to water under the Water and Soil Conservation Act 1967 or otherwise.

  6. For the purpose of assessing the rental or annual sum payable in respect of this consent, the maximum generating capacity of the plant at the date of this consent is 5 kW.

SCHEDULE

GENERAL DESCRIPTION OF WORKS

(a) Headworks consisting of a dam and intake with a water race leading to the powerhouse giving a static head of approximately 19.812 metres.

(b) Pelton wheel and powerhouse with all necessary equipment for generating electricity situated in S.G. Run 141 Patriarch Survey District.

(c) Tailrace leading from the powerhouse to the Wairau River.

As shown on the plan marked N.Z.E. 986, deposited in the office of the Electricity Division, Ministry of Energy, at Wellington.

Amending Determinations by the Minister of Customs under Section 121 of the Customs Act 1966

PURSUANT to section 121 of the Customs Act 1966, the Minister of Customs hereby amends, in the manner set out in the Schedule hereto, the determinations made under the said section on the 24th day of October 1975 and published in the New Zealand Gazette on the 13th day of November 1975, at p. 2546, 2547, and 2548, and varied by notices in the New Zealand Gazette on the 1st day of April 1976, at p. 632, on the 17th day of March 1977, at p. 1667.

SCHEDULE

Part II of the Determinations is amended by:

(i) Revoking paragraph I (b) and amending I (c) to read “I (b)”.
