Declaring Land Acquired for a Local Work to be Crown Land

A PROCLAMATION

PURSUANT to the Public Works Act 1928, I, The Right Honourable Sir Keith Jacka Holyoake, the Governor-General of New Zealand, hereby declare the land described in the First and Second Schedules hereto, subject to drainage easements and drainage rights, to be Crown land subject to the Land Act 1948.

FIRST SCHEDULE

HAWKE'S BAY LAND DISTRICT

ALL those pieces of land situated in Block II, Te Mata Survey District, Hawke's Bay County, Hawke's Bay R.D., described as follows:

0 1 13.6 Parts Lot 4, D.P. 3794, being part Turamoe No. 1 Block. Subject to easement as to drainage created in transfers No. 15055 and 36610; coloured blue on plan.

Declaring Access Ways to be Vested in and be Under the Control and Management of the Manukau City Council

ORDER IN COUNCIL

At the Government Buildings at Wellington this 9th day of April 1979.

Pursuant to section 11 of the Housing Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the access ways, described in the Schedule hereto shall, on and after the date of this Order in Council, vest in and be under the control and management of the Manukau City Council.

Auckland Harbour Board (Westhaven) Foreshore and Harbour Bed Control Order 1979

Governor-General

ORDER IN COUNCIL

At the Government House at Wellington this 14th day of May 1979.

Present:

His Excellency the Governor-General in Council

Pursuant to section 165 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. (a) This order may be cited as the Auckland Harbour Board (Westhaven) Foreshore and Harbour Bed Control Order 1979.

(b) This order shall come into force on the date of its publication in the Gazette.

  1. In this orderβ€”

"The Act" means the Harbours Act 1950;

"The Board" means the Auckland Harbour Board;

"Foreshore" means such part of the bed, shore, or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tide;

"Minister" means the Minister of Transport, and includes any officer, person, or authority acting by or under the direction or authority of the Minister.

  1. There is hereby granted to the board for a period of 21 years from the commencement of this order; subject to the provisions of section 165 of the Act, and to the conditions described in the Second Schedule to this order, control of the foreshore and harbour bed as described in the First Schedule to this order.

FIRST SCHEDULE

ALL that portion of foreshore and harbour bed of Waitemata Harbour being part of the Westhaven boat harbour development and as more particularly shown hatched red on plan M.D. 15945, and deposited in the office of the Ministry of Transport at Wellington.
