PURSUANT to the Soil Conservation and Rivers Control Act 1941, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares that the Schedule hereto is to be substituted with effect on 15 March 1979 for the Schedule in Order in Council dated 19 March 1979 and published in the Gazette of 15 March 1979, No. 18, page 558.

SCHEDULE

ALL that area in the Otago Land District as described from N.Z.M.S. 261, Sheet J. 41 first edition, and associated survey plans and certificates of title, and commencing on the sea coast at the south-western corner of an easement as shown on Survey Office Plan 8644; thence in a north-westerly direction along the south-western boundary of the aforesaid easement to a point on the north-eastern boundary of Section 146, Block 2, Papakaio Survey District, being the intersection of that boundary with the south-western boundary of the aforesaid easement; thence in a north-westerly direction along the north-eastern boundaries of Sections 146, 145, and part Section 142, in the aforesaid block and survey district to the north-western corner of the last-named section; thence in a north-westerly direction along the south-western boundary of Works Road to the intersection of the south-eastern boundary of State Highway 1; thence in a westerly direction by a right line across State Highway 1 to the most southerly corner of Lot 2, D.P. 11712; thence again in a north-westerly direction across State Highway 83 to the south-east corner of D.P. 2452; thence, generally, in a north-westerly direction by the eastern boundary of D.P. 2452, and the eastern and north-eastern boundaries of part Section 116, and Sections 115, 75, and 74, Block 2, Papakaio Survey District, to the north-eastern corner of Section 74; thence due west by the northern boundaries of Sections 74 and 73 to the south-eastern corner of Section 9S, Rosebery Settlement; thence due north by the eastern boundary of Section 9S to the north-western corner of Section 66, Block 2, Papakaio Survey District; thence in a north-westerly direction by a right line across Section 9S to the intersection of the northern boundary of Block 2, Papakaio Survey District, with the eastern boundary of Schulte Road; thence, generally, northerly and westerly by the eastern, north-eastern, and northern boundaries of Schulte Road to the intersection of the eastern boundary of Section 2S, Rosebery Settlement, Block 1, Papakaio Survey District; thence northerly and westerly along the northern boundaries of Section 2S and 1S to the north-western corner of Section 1S of the aforesaid Settlement; thence northerly and north-easterly along the eastern boundaries of Section 6A, Airedale Settlement, Block 1, Papakaio Survey District, to the north-eastern corner of Section 6A; thence, generally, westerly along the southern boundary of Horse Gully Road to the most northerly point on the boundary of Airedale Settlement; thence in a northerly direction along the western boundary of the Papakaio Survey District to the south-eastern corner of part Section 5S, Pukemi Settlement, Block 4, Awamoko Survey District; thence westerly to a point on the southern boundary of the aforesaid section 32 chains (643.74 metres) from the south-eastern corner of the aforesaid section; thence in a north-westerly direction by a right line across part Section 5S to the north-western corner of the aforesaid section; thence due west across Section 9S, Pukemi Settlement, Block 4, Awamoko Survey District, to a point on the north-eastern boundary of the aforesaid section, being the intersection of that boundary with the south-eastern boundary of Ridge Road; thence, generally, north-easterly along the south-eastern boundary of Ridge Road to its intersection with the south-western boundary of State Highway 83; thence south-easterly along the aforesaid boundary of State Highway 83 to the most northerly point of Lot A, D.P. 834; thence in an easterly direction by a right line across State Highway 83 to the intersection of the north-eastern boundary of State Highway 83 with the southern boundary of Seven Mile Road; thence easterly along the aforesaid southern boundary to its intersection with the north-eastern boundary of State Highway 1; thence, again, due east by a right line across State Highway 1 to the south-eastern boundary of State Highway 1; thence north-easterly along that boundary to its intersection with the southern boundary of Seacliff Road; thence easterly along its southern boundary to the north-eastern corner of Section 76A, Steward Settlement, Block 8, Papakaio Survey District; thence in a south-westerly direction along the coast to the point of commencement.

Raglan Harbour Board Foreshore Control Order 1979

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 165 of the Harbours Act 1950, His Excellency the Governor-General acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

1. (a) This order may be cited as the Raglan Harbour Board Foreshore Control Order 1979.

   (b) This order shall come into force on the date of its publication in the Gazette.

2. In this order:

   “The Act” means the Harbours Act 1950;

   “The Board” means the Raglan Harbour Board;

   “Foreshore” means such part of the bed, shore or banks of a tidal water as are covered and uncovered by the flow and ebb of the tide at ordinary spring tide;

   “Minister” means the Minister of Transport and includes any officer, person, or authority acting by or under the direction or authority of the Minister.
