Declaring Land and an Easement Over Land Taken for Harbour Works in the City of Auckland

PURSUANT to section 32 of the Public Works Act 1928 and section 35 of the Finance Act (No. 2) 1945, the Minister of Works and Development hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for harbour works, and a right of way easement appurtenant to the land described in the said First Schedule is hereby taken over the land described in the Second Schedule hereto for harbour works, vesting in the Auckland Harbour Board and its servants, tenants, agents, workmen, and invites the free and perpetual right from time to time and at all times by day and by night to go, pass and repass, with or without carriages, vehicles, motor vehicle machinery, animals and implements, all of any kind, over and along the land described in the said Second Schedule, from and after the 11th day of January 1979.

FIRST SCHEDULE
NORTH AUCKLAND LAND DISTRICT
(Land for Harbour Works)

ALL that piece of land containing 6892 square metres, situated in the City of Auckland, and being part Old Bed of the Waitemata Harbour (part Proclamation 15127); marked “A” on plan.

SECOND SCHEDULE
NORTH AUCKLAND LAND DISTRICT
(Land over which Easement is Taken)

ALL that piece of land, situated in the City of Auckland, and being the residue of part Old Bed Waitemata Harbour in Proclamation 15127; marked “B” on plan.

ALL that piece of land, situated in the City of Auckland, and being part Old Bed Waitemata Harbour; marked “C” on plan.

As shown on plan S.O. 52707, lodged in the office of the Chief Surveyor at Auckland, and thereon marked as above-mentioned.

(b) Stops the said road.
