  1. In terms of section 82 (7) of the Commerce Act 1975, the Minister of Trade and Industry has, in a letter dated 14 September 1978, requested the Commerce Commission to inquire into and, after hearing all parties wishing to present submissions, report to him on the advisability of removing indigenous timber from the Positive List of Controlled Goods.

  2. The full text of the Minister’s letter is set out below:

“In terms of its policy for the conservation and better utilisation of indigenous timber, the Government is giving consideration to the removal of all forms of statutory price control from indigenous timber.

Indigenous timber is presently included in the item, Timber (New Zealand grown),

contained in the Positive List of Controlled Goods and Services specified in terms of section 82 (1) of the Commerce Act 1975.

To assist the Government in its consideration of this matter, I hereby require the Commerce Commission, in terms of subsection 7 of section 82 of the Commerce Act 1975, to inquire into and report to me as soon as practicable on the advisability of removing indigenous timber from the Positive List of Controlled Goods and Services. In conducting its inquiry, the Commission (and parties to the inquiry) should take account of the general policy stated in the first paragraph. This means that, following the inquiry concerning removal of indigenous timber from the Positive List, the eventual action by the Government could be the exemption of indigenous timber from all forms of statutory price control or surveillance.”

A list of indigenous timber species commercially available in New Zealand is attached. I have also listed the main commercial species of New Zealand grown exotic timber that will not be affected by your inquiry.

Where possible such parties should also indicate briefly the general or specific nature of their interest. The Commission will then determine the admission of parties in terms of section 14 (1) of the Act.

  2. In any case where two or more separate parties wish to be heard and/or represented jointly in the inquiry, they should so inform the Commission so that the Commission can consider giving leave for this to be done in terms of section 14 (4) of the Act.
