PURSUANT to the Agricultural Pests Destruction Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order:

ORDER

  1. (1) This order may be cited as the Pest of Local Importance Order 1978, No. 2.
    (2) This order shall come into force on the day after its notification in the Gazette.

  2. The opossum is hereby declared a pest of local importance in the Otamatea County Pest Destruction District.

Hawke’s Bay County—Havelock North Borough Boundary Alteration Order 1978

PURSUANT to the Local Government Act 1974, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

1. Title and Commencement—(1) This order may be cited as the Hawke’s Bay County—Havelock North Borough Boundary Alteration Order 1978.
(2) This order shall come into force on the 1st day of October 1978.

2. Boundaries of Hawke’s Bay County and Havelock North Borough Altered—The boundaries of Hawke’s Bay County and Havelock North Borough shall be altered by excluding from the district of Hawke’s Bay County and including in the district of Havelock North Borough the areas described in the Schedule to this Order.

3. Transitional Provisions—The Havelock North Borough Council, in respect of the areas described in the Schedule to this order:

(a) Shall have and may exercise and be responsible for all the powers, duties, acts of authority, and functions which were previously exercised, or which would have been so exercised, by the Hawke’s Bay County Council;

(b) Shall have and may exercise and be responsible for all liabilities, obligations, engagements, and contracts which previously were, or which would have been, the responsibility of the Hawke’s Bay County Council;

(c) Shall have and may exercise and be responsible for all actions, suits, and proceedings pending by or against, or which would have been the responsibility of, the Hawke’s Bay County Council;

(d) Shall succeed to the bylaws which are in force in those areas, and which are applicable to the altered circumstances of the Havelock North Borough Council; and, until revoked or altered by the Havelock North Borough Council, every such bylaw shall remain in force in the area in which it was in force immediately before the alteration of boundaries; and every bylaw which cannot be restricted to that area shall be deemed inapplicable and revoked by the alteration of boundaries;

(e) Shall succeed to all rates or levies and other money payable in respect of those areas to the Hawke’s Bay County Council;

(f) Shall succeed to the valuation rolls, electoral rolls and rate records in force in those areas until it makes such rolls or records for those areas; and until that time Part IX of the Rating Act 1967 shall apply as if the district in which that area was included was the district of a special purpose authority and the areas from which it was formed were constituent districts.

4. Vesting of Land Formerly Vested in the Corporation of the District of Hawke’s Bay County—The corporation of the district of Havelock North Borough shall, in respect of those areas described in the Schedule to this order, have vested in it, subject to all existing encumbrances, all land situated in those areas that was previously vested in the Corporation of the District of the Hawke’s Bay County.

5. Mayor and Principal Officer—The Mayor and principal officer of the Havelock North Borough Council shall exercise the duties, powers, and functions of the chairman and principal officer of the Hawke’s Bay County Council in respect of the area described in the Schedule to this order.

6. Creditors—Subject to section 37F of the Local Government Act 1974, the rights or interests of creditors of any districts affected by this order shall not be affected.

7. Rating—The system of rating in the areas referred to in clause 2 of this order shall continue to be the land value system.

SCHEDULE

FIRSTLY, all that area in the Hawke’s Bay Land District containing 36.8350 hectares, more or less, being portion of the County of Hawke’s Bay, bounded by a line commencing at a point being the south-eastern corner of Part Lot 13, D.P. 1647; thence south-easterly along the north-eastern side of the Hastings-Waimarama Road to the south-eastern corner of Part Lot 14, D.P. 1647; thence south-easterly on a right line across the Hastings-Waimarama Road to the north-eastern corner of Lot 6, D.P. 2170; thence south-easterly, generally, along the north-eastern boundaries of Lot 6, D.P. 2170, and Lots 1 and 2, D.P. 10654, to the easternmost corner of Lot 2, D.P. 10654; thence westerly, generally, along the southern boundaries of the said Lot 2, D.P. 10654 and the production of that line to the eastern side of Durham Drive; thence north-westerly on a right line across Durham Drive to and along the south-eastern and south-western boundaries of Lot 2, D.P. 2879; thence northerly, generally, along the western boundaries of the said Lot 2, Lot 3, D.P. 10096, and Lot 3, D.P. 10350, to the north-western corner of the last mentioned Lot; thence easterly along the northern boundaries of Lot 3 and Lot 2, D.P. 10350 and the production of that line to the eastern side of Durham Drive; thence north-westerly along that roadside to its intersection with the southern side of the Hastings-Waimarama Road; thence on a right line across the said road to the point of commencement; and

SECONDLY, all that area in the Hawke’s Bay Land District containing 3.1000 hectares, more or less, being portion of the County of Hawke’s Bay bounded by a line commencing at a point being the north-eastern corner of Lot 2, D.P. 11807; thence by a right line to a road angle on the western side of Tauroa Road being a point in line with the northern boundary of Lot 2, D.P. 11807; thence southerly, generally, along the western side of Tauroa Road to the south-eastern corner of Part Lot 6, D.P. 4251; thence north-westerly along the south-western boundary of the aforesaid Lot to the eastern boundary of Lot 1, D.P. 9094; thence northerly along that eastern boundary and its production to its intersection with the southern boundary of Lot 1, D.P. 11807; thence westerly along the southern boundary and northerly along the western boundary of Lot 1 aforesaid to the south-western corner of the right-of-way shown on D.P. 10083; thence easterly along the southern boundary of the right-of-way aforesaid and its production to the easternmost corner of Lot 1, D.P. 11807;
