Consent to the Distribution of New Therapeutic Drugs
PURSUANT to section 12 of the Food and Drug Act 1969, the Minister of Health hereby consents to the distribution in New Zealand of the new therapeutic drug set out in the Schedule hereto.

Price Order No. 81 (Apples and Pears)
PURSUANT to the Commerce Act 1975, I, Desmond James Gasson, pursuant to a delegation from the Secretary of Trade and Industry, hereby make the following price order:

This order may be cited as Price Order No. 81 and shall come into force on the 10th day of February 1978.

(1) Price Order No. 55† is hereby revoked.
(2) In this order, unless the context otherwise requires—
“Board” means the New Zealand Apple and Pear Marketing Board, established under the Apple and Pear Marketing Act 1971, and includes an authorised agent of the Board;
“List Price” means the wholesale price issued from time to time by the Board.
APPLICATION OF THIS ORDER
- This order shall apply with respect to the retail sale of all apples and pears grown in New Zealand and purchased from the Board.
MAXIMUM RETAIL PRICES
- The maximum price that may be received or charged by a retailer for apples and pears to which this order applies shall be determined in accordance with the appropriate following subclause:
(A) For sales of less than case or carton lots of pears purchased by a retailer as follows:
(I) Where the scales used by the retailer weigh in imperial weights—
The amount per pound arrived at by dividing the sum of the following items (a) to (c) by 38.59:
(a) The list price.
(b) 32 cents cartage allowance per bushel case or carton.
(c) 45 percent of item (a).
(II) Where the scales used by the retailer weigh in metric weights—
The amount per kilogram arrived at by dividing the sum of the following items (a) to (c) by 17.5 in respect of pears:
(a) The list price.
(b) 32 cents cartage allowance per bushel case or carton.
(c) 45 percent of item (a).
(B) For sales of less than carton lots of apples and pears purchased by a retailer in 15 kg cartons packed by the Board or in “Applecrates” packed by the Board:
(I) Where the scales used by the retailer weigh in imperial weights—
The amount per pound arrived at by dividing the sum of the following items (a) to (c) by 33.069:
(a) The list price.
(b) 32 cents cartage allowance per 15 kilogram carton.
(c) 40 percent of item (a) for apples and 45 percent in respect of pears.
(II) Where the scales used by the retailer weigh in metric weights—
The amount per kilogram arrived at by dividing the sum of the following items (a) to (c) by 15:
(a) The list price.
(b) 32 cents cartage allowance per kilogram carton.
(c) 40 percent of item (a) for apples and 45 percent in respect of pears.
(C) For sales of less than case or carton lots of apples or pears purchased by a retailer as follows:
(i) Loose apples in apple bushel cases or apple bushel cartons.
(ii) Loose pears in pear bushel cases or pear bushel cartons.
(I) Where the scales used by the retailer weigh in imperial weights—
The amount per pound arrived at by dividing the sum of the following items (a) to (c) by 30.87:
