Assessment of Levy—

(a) From 1 July 1978 every entitlement holder shall pay to the Authority a variable entitlement levy in respect of each laying bird authorised to be kept pursuant to his or its entitlement licence. Such levy shall be payable for each “statistical period” that licensed distributors are authorised by the Authority, pursuant to Regulation 65 (2) of the Egg Marketing Authority Regulations 1953, to deduct levies on eggs (“floor downpayments”) from the proceeds of eggs consigned to them for sale, and shall be paid in the manner and at the times set out below. The rate of variable entitlement levy for each “statistical period” shall be 20 times the rate of “floor downpayment” per dozen eggs for that period divided by 12. For this purpose “statistical period” means any one of 12 periods, each of either 4 or 5 weeks, into which each year is divided by the Authority for statistical and accounting purposes.

(b) The manner of assessing levies payable set out in (a) above shall have continuing effect until any variation thereof shall have been determined and approved in the manner prescribed by Regulation 75B (2) provided that the total amount of variable entitlement levy imposed shall not exceed $2 in relation to each bird authorised to be kept under an entitlement licence.

Payment of Levy—

(c) Levies assessed and payable as above shall be debited in the books of the Authority to the accounts of the entitlement holders concerned. In the case of entitlement holders who are egg floor suppliers, payment shall be made by deduction from each such entitlement holder’s account sales by the licensed egg distributors to whom the eggs are consigned for sale. Such amounts deducted shall be forwarded by those distributors to the authority at the same time as payment is made to the entitlement holder for eggs received. Any levy which is not received by the Authority by way of deduction from the account sales is to be paid by the entitlement holder direct to the Authority by the 20th of the month following the month levied. Where the entitlement holders do not supply any eggs to a licensed distributor payment is to be made direct by each such entitlement holder to the Authority by the 20th of the month following the month levied.

(d) An entitlement levy charged to an entitlement holder shall be in lieu of, and replace, any levies payable to the Authority and authorised (pursuant to Regulations 65 (2) of the Egg Marketing Authority Regulations 1953) to be deducted from the proceeds of eggs consigned to a licensed distributor for sale.

(1) of the Social Security (General Medical Services) Regulations 1950, the Minister of Health, acting on the recommendation of the Medical Practitioners’ Disciplinary Committee, hereby excludes Dr C.
