NOTICE is hereby given that a petition for the winding up
of the above-named company was, on the 29th day of June
1978, presented to the said Court by J. B. FERGUSON & COM-
PANY LIMITED, a duly incorporated company having its
registered office at Christchurch; and the said petition is
directed to be heard before the Court sitting at Christchurch
on the 26th day of July, at 10 o'clock in the forenoon; and
any creditor or contributory of the said company desirous
to support or oppose the making of an order on the said
petition may appear at the time of hearing in person or by
his counsel for that purpose; and a copy of the petition

1955, and IN THE MATTER of an application for an order
restoring the company OAK HOLDINGS LIMITED to the
Register of Companies.

Wednesday, the 24th day of May 1978

BEFORE HIS HONOUR, MR JUSTICE WHITE

UPON reading the notice of motion for an order to have a
company restored to the Register and upon reading the
affidavits of Frances Mary McCurrach, Stanley Edgar Esam
and Wilce Edward van Asch and upon hearing Mr Rea,
Counsel for the Registrar of Companies it is hereby ordered
that the name of the company known as OAK HOLDINGS
LIMITED be restored to the Register of Companies at Napier
by the Registrar of Companies and it is hereby further
ordered that the Registrar of Companies do and he is hereby
directed to advertise in his official name in the New Zealand
Gazette this order for the purpose of placing the said company
in the same position as nearly as may be as if the name
of the said company had never been struck off the Register
and it is also ordered:

(i) That upon the said OAK HOLDINGS LIMITED being so
restored to the Register, annual returns for the years 1975,
1976, and 1977 be filed with the Registrar of Companies and
the said OAK HOLDINGS LIMITED shall make payment to the
Registrar of Companies of the following fees: (a) late filing
fees of $25 for each of the years 1975, 1976, and 1977; (b)
annual licence fee of $6 in respect of the 1975 year; and
(c) annual return fee of $10 for each of the years 1976 and
1977.

(ii) That the said OAK HOLDINGS LIMITED shall make
payment of the Crown Solicitor's fees of $50 on the applica-
tion and the costs of the Registrar of Companies of $100
on the application.

THE WAIHEKE COUNTY COUNCIL

NOTICE OF INTENTION TO TAKE LAND

IN the matter of the Public Works Act 1928, and the Counties
Act 1956:

NOTICE is hereby given that the Waiheke County Council
requires and intends under the provisions of the above-
mentioned Acts to take, in the manner provided by the
Public Works Act 1928, for road, the pieces of land described
in the Schedule hereto, such land to be used for the general
purposes of the formation of a road at Rocky Bay and
Awaawaroa Bay, Waiheke Island. And notice is hereby further
given that plans showing the pieces of land so required to be
taken are deposited at the public office of the said Council
at 10 Belgium Street, Ostend, Waiheke Island, and are there
open for inspection without fee by all persons during the
ordinary office hours. And notice is further given that
every person directly affected by the taking of the said land
is hereby called upon to set forth in writing any objection
he may wish to make to the taking of the said land, not
being an objection to the amount or payment of com-
pensation, and to send their written objection within 40 days
from the first publication of this notice to the Town and Country
Planning Appeal Board, 175 The Terrace, Wellington (Private
Bag, Postal Centre, Wellington). If any objection is made
a public hearing of the objection will be held unless the
objector otherwise requires, and each objector will be advised
of the time and place of the hearing.
