A PROCLAMATION

PURSUANT to the Public Works Act 1928, I, The Right Honourable Sir Keith Jacka Holyoake, the Governor-General of New Zealand, hereby proclaim and declare that an easement is hereby taken for waterworks over the land described in the Schedule hereto, and shall vest in the Wanganui City Council the full, free, uninterrupted, and unrestricted right, liberty, and privilege for the said parcels of land from time to time, and at all times to convey water along the stipulated course across the said parcels of land by means of underground pipes, and with the full, free, uninterrupted, and unrestricted right, liberty, and privilege to use any line of pipes already laid on the stipulated course, or any pipe or pipes in replacement or in substitution for, all or any of those pipes, and in order to maintain the efficiency of any such pipeline that the said Council’s servants, agents, and workmen shall have the full, free, uninterrupted, and unrestricted right, liberty, and privilege, together with any tools, implements, machinery, vehicles, and/or equipment of whatsoever nature necessary for the purpose, to enter upon the land over which the easement is taken, by such route as is reasonable in the circumstances, and to remain there for the purpose of laying, inspecting, cleansing, repairing, maintaining, and renewing the pipeline or any part thereof, and of opening up the soil of that land to such an extent as may be necessary and reasonable in that regard, subject to the condition that as little disturbance as possible is caused to the surface of the land and that the surface is restored as nearly as possible to its original condition and any damage done by reason of the aforesaid operation is repaired, and I also declare that this Proclamation shall take effect on and after the 15th day of June 1978.
