This order may be cited as the Loburn Irrigation Order 1978.

The Minister of Works and Development is hereby authorised to construct, maintain, and control the water supply works described in the First Schedule hereto to serve the district described in the Second Schedule.

The area of land described in the said Second Schedule is hereby constituted as an irrigation district to be known as the Loburn Irrigation District (herein referred to as “the district”).

It is hereby declared that the basic charge payable on all irrigable land within the said district shall be $30 per irrigable-hectare-per-year and the water availability charge for each property shall be $160 per season for each litre per second continuous flow made available during that season.

Basis of allocation—Supply of water is subject to the terms of the Water Right No. NCY 770137, issued by the North Canterbury Catchment Board and Regional Water Board. This right provides for the continuous taking of 4582 cubic metres per day at a rate not exceeding 53 litres per second from the Okuku River. (A reduction is expected about once in 10 years.) The right allows an average supply of 2.25 litres per tree per hour on an assessed tree density of 333 trees per hectare for all the defined irrigable area, provided the water supply permits the exercising of the full right granted.

Reduction shall be made to the charges given above during the first six irrigation seasons so that the charges for the first seven seasons shall be as set out in the Third Schedule hereto.

It is hereby declared that after the seventh season of water availability, charges shall be subject to annual adjustment (from the end of the above season of supply) to compensate for any differences in any element of these charges from the amount previously estimated as stated under sections 13 and 15 of the Public Works Amendment Act 1975.
FIRST SCHEDULE
WATER SUPPLY WORKS
THE Loburn Irrigation Works by which means water can be drawn from the Okuku River by a piped water supply to a storage reservoir and from this point the said water will be either reticulated to a holding tank on the property or supplied through a restrictor valve to the property as appropriate to enable trickle irrigation of established and proposed orchards as well as limited areas of other horticultural crops. The said works include all reservoirs, piping, gauges, boxes, valves, pumps, meters and all other works incidental to or required for the construction, maintenance and control of the said works for the irrigation of the district.
SECOND SCHEDULE
LOBURN IRRIGATION DISTRICT
THE land to be included in the irrigation district is described as all those areas in the Canterbury Land District, Ashley County, described as follows:
Firstly, all that area bounded by a line commencing at the south-eastern corner of part Lot 18, D.P. 4199, in Block II, Rangiora Survey District, and proceeding westerly along the southern boundaries of that lot and Reserve 4350 to the eastern side of Loburn-Whiterock Road; thence northerly along that roadside to a point in line with the southern boundary of Lot 1, D.P. 4979, thence westerly to and along that boundary and north-westerly, easterly, southerly, and north-easterly along the south-western, northern, eastern, and north-western boundaries of that lot and the production of the last-mentioned boundary to the eastern side of Loburn-Whiterock Road; thence northerly along that roadside to a point in line with the southern boundary of part Lot 3, D.P. 5629, comprised in certificate of title No. 1D/483; thence north-westerly and easterly along the south-western and northern boundaries of that part lot to and north-easterly along the north-western boundary of part Lot 3, D.P. 7042, and its production to the eastern side of Loburn-Whiterock Road; thence northerly along that roadside to a point in line with the southern boundary of Lot 29, D.P. 4199; thence westerly to and along that boundary to and north-westerly along the south-western boundaries of that lot and Lot 2, D.P. 5629, Lots 25, 24, and 23, D.P. 4199, Lot 1, D.P. 5629,
and Lot 19, D.P. 4199, to the north-western boundary of the last-mentioned lot; thence north-easterly along that boundary to the south-western boundary of Lot 1, D.P. 28233; thence north-westerly and north-easterly along that boundary and the north-western boundary of that lot and the production of the last-mentioned boundary to the eastern side of Loburn-Whiterock Road; thence northerly along that roadside to the north-western boundary of Lot 2, D.P. 10448; thence north-easterly along that boundary to the right bank of the Makerikeri River; thence southerly generally along that bank to the point of commencement.
Secondly, all that area bounded by a line commencing at the south-eastern corner of Rural Section 21720 in Block VI, Rangiora Survey District, and proceeding westerly and northerly along the southern and western boundaries of Rural Sections 21720, 9786, and 7812, and the production of the last-mentioned boundary to the northern side of Dixons Road; thence north-westerly along that roadside to the eastern side of Makerikeri Road; thence north-easterly along that roadside to a point in line with the southern boundary of Rural Section 38952; thence westerly to and along that boundary to the left bank of the Makerikeri River; thence northerly along that bank to the north-western boundary of Rural Section 33739; thence north-easterly along that boundary to the western side of Makerikeri Road; thence southerly along that roadside to and along that boundary to and south-easterly along the north-eastern boundary of that section and its production to the south-eastern side of Wallers Road; thence south-westerly along that roadside to the eastern side of Makerikeri Road; thence southerly along that roadside to and continuing southerly along the eastern boundary of Lot 5, D.P. 6330, to the northern boundary of Lot 4, D.P. 6330; thence easterly along the northern boundaries of that lot, part Lot 3, and Lots 2 and 1, D.P. 6330, to the eastern boundary of Lot 1, D.P. 6330; thence southerly along that boundary and its production to the southern side of Dixons Road; thence easterly along that roadside to the eastern boundary of Lots 1–4, D.P. 28599, to the northern boundary of Lot 2, D.P. 2886; thence easterly, southerly, and westerly along the northern, eastern, and southern boundaries of that lot and the production of the last-mentioned boundary to the western side of Fletchers Road; thence southerly along that roadside and the western boundary of Rural Section 21720 to the point of commencement.
Thirdly, all that area being Rural Section 26794, situated in Block VI, Rangiora Survey District.

PURSUANT to sections 156 and 157 of the Transport Act 1962, and section 33 of the Air Services Licensing Act 1951, His Excellency the Governor-General has been pleased to appoint Eric Francis Rothwell
retired Magistrate, of Auckland, as Transport Licensing Appeal Authority, Transport Charges Appeal Authority, and Air Services Licensing Appeal Authority, for the period commencing on 15 February 1978 and ending on 31 March 1978.
