Defining Harbour Limits of Tarakohe Harbour

ORDER IN COUNCIL

At Government Buildings at Wellington this 7th day of February 1978

Present:

THE RIGHT HON. R. D. MULDOON PRESIDING IN COUNCIL

PURSUANT to the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby defines the limits of Tarakohe Harbour as set out in the Schedule to this order. The Order in Council made on 8 November 1976* defining the limits of Tata Bay Harbour is hereby revoked.

SCHEDULE

ALL of that area of sea and tidal waters enclosed by a circle of 3 nautical miles radius from the Abel Tasman Monument which position is defined as latitude 40° 49.36' S longitude 172° 54.12' E.

Alteration of Boundaries—Whangarei City and County

PURSUANT to the Local Government Act 1974, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order shall come into force on the 1st day of April 1978.

  2. The boundaries of Whangarei City and Whangarei County shall be altered by excluding from the district of Whangarei County and including in the district of Whangarei City all the areas of land described in the Schedules hereto.

SCHEDULE A

ALL that area in the North Auckland Land District, Whangarei County, containing 41.6 hectares, more or less, bounded by a line commencing at the south-easternmost corner of Lot 2 D.P. 45066 in Block VIII, Purua Survey District, and proceeding westerly along the southern boundary and northerly along the western boundary of Lot 2, D.P. 45066, to and westerly and northerly along the southern and western boundaries of that part of Kotenikau Block contained in C.T. 22D/1171; thence south-westerly along the south-eastern boundary of the aforesaid Block, to and north-westerly generally along the south-western boundaries of the said Block and the last boundary produced across Bush Road to its northern side; thence easterly along the northern side of Bush Road to the south-western corner of Otapaa Block; thence north-westerly and north-easterly along the south-western and north-western boundaries of Otapaa Block to a point in line with the south-western boundary of that part of Otapaa Block shown on D.P. 4543; thence south-easterly generally along the boundary of Whangarei City as described in New Zealand Gazette 1969, p. 299, to the point of commencement.

SCHEDULE B

ALL that area in the North Auckland Land District, Whangarei County, containing 20.9 hectares, more or less, bounded by a line commencing at the intersection of the middle of Gillingham Road with the right bank of Waitaua Stream in Block VIII, Purua Survey District, and proceeding easterly generally along the right bank of Waitaua Stream to the northernmost corner of Lot 12, D.P. 1583; thence south-westerly and north-westerly along the boundary of Whangarei City as described in New Zealand Gazette 1969, p. 299, to the point of commencement.

SCHEDULE C

ALL that area in the North Auckland Land District, Whangarei County, containing 214.5 hectares, more or less, bounded by a line commencing at the intersection of the western side of Vinegar Hill Road with the right bank of the Waitaua Stream in Block V, Whangarei Survey District, and proceeding easterly generally along the right bank of the Waitaua Stream to, and south-easterly generally along the northern side of the Hataa River to its intersection with the northern side of Parunui Valley Road; thence easterly along that northern roadside to and southerly along the left bank of the Hataa River and continuing south-westerly along the north-western side of Whareora Road to the southern boundary of Allotment W17, Parahaki Parish; thence south-easterly along a right line across Wharcora Road to the northernmost corner of Allotment 83a, Parahaki Parish, and easterly along the northern boundaries of the aforesaid Allotment and Lot 4, Deeds Plan W26, to and southerly along the eastern boundaries of the said Lot 4 and Lots 4 and 3, D.P. 37540, to the southernmost corner of that Lot 3, in Block IX, Whangarei Survey District; thence north-westerly and westerly along the north-eastern and northern boundaries of that part of Parahaki Block held as a Bird Sanctuary in C.T. 13D/1308, and its production to the middle of Hataa River, thence northerly and north-westerly generally along the boundary of Whangarei City as described in New Zealand Gazette 1969, p. 299, to the point of commencement.

SCHEDULE D

ALL the area in the North Auckland Land District, Whangarei County, containing 75.1 hectares, more or less, bounded by a line commencing at the northernmost corner of Allotment 2, Parahaki Parish, in Block IX, Whangarei Survey District, and proceeding north-easterly generally along the north-western boundaries of Lots 4, 3, and 2, D.P. 58055, and Lot 3, D.P. 46522, to its northernmost corner; thence south-easterly along the north-eastern boundaries of Lot 3, D.P. 46522. Lot 1, D.P. 58055, Lot 1, D.P. 70352, the end of Memorial Drive and the north-eastern boundary of Lot 1, D.P. 53068, to and easterly generally along the northern side of the public road forming the generally northern boundaries of Lot 6, D.P. 18256, to the westernmost corner of Allotment 111, Parahaki Parish; thence southerly along a right line across Old Parua Bay Road to and south-westerly generally along the middle of the said road to its intersection with the boundary of Whangarei City described in New Zealand Gazette 1969, p. 299; thence westerly, north-westerly, and north-easterly generally along the boundary of Whangarei City to the point of commencement.

SCHEDULE E

ALL that area in the North Auckland Land District, Whangarei County, containing 134.6 hectares, more or less, bounded by a line commencing in Block XII, Purua Survey District, at the south-western corner of that part of Tokitaruna Block contained in C.T. 26A/637, and proceeding north-westerly generally along the south-western boundary of the said Block and the north-eastern boundaries of Lot 4, D.P. 13587, to the southernmost corner of Allotment 8, Pukenui Parish; thence easterly generally along the generally southern boundaries of Allotment 8, Pukenui Parish, to and northerly along the eastern boundary of the said Allotment 8 to the westernmost corner of Lot 1, D.P. 40137; thence easterly and southerly generally along the northern and generally eastern boundaries of that Lot 1, to and southerly and easterly generally along the western and southern boundaries of that part of Horahora No. 2 Block, contained in C.T. 1079/28, to the westernmost corner of Lot 1, D.P. 39096; thence southerly and westerly generally along the boundary of Whangarei City as described in New Zealand Gazette 1969, p. 299, to the point of commencement.

SCHEDULE F

ALL that area in the North Auckland Land District, Whangarei County, containing 70.0 hectares, more or less, bounded by a line commencing at the southernmost corner of Lot 2, D.P. 46220, in Block XVI, Purua Survey District, and proceeding north-westerly along the south-western boundary of that Lot 2 to the middle of Raumanga Stream; thence easterly generally and south-westerly along the boundary of Whangarei City as described in New Zealand Gazette 1969, p. 299, to the point of commencement.
