IN the matter of the Indecent Publications Act 1963, and in the matter of an application by Fisk Publishing Co. Ltd, and an application by the Comptroller of Customs in respect to the following publication: Mayfair Magazine, Volume 12, Nos. 4, 5, 6 and 12, published by Fisk Publishing Co. Ltd., London.

Decision
Mayfair has been considered on two earlier occasions by the Tribunal, the most recent being 4 years ago. The earlier decisions (Nos. 574-5 and 798) found the magazine to be indecent. On this occasion we have examined the four issues which have been before us in recent months—Penthouse (English edition) and Oui. Mayfair has a somewhat more even balance—half to two-thirds rather than three-quarters or more—than either of the other two between sexual and non-sexual material, and it may also be said that the majority of photographs are somewhat less contrived and artificial than the normal standard of the other two. It does not appear to the Tribunal that allowing adults to read Mayfair will be injurious to the public good, and it accordingly classifies these four issues as indecent in the hands of persons under the age of 18 years, and in the terms of section 15A (1) of the Act makes a restriction order in similar terms for a period of 2 years.

Decision
At fairly regular intervals the Tribunal has had to consider the respective American and British editions of Penthouse. The American edition is, by decision No. 883 of 2 June 1977, restricted for a period of 2 years to persons 18 years of age and over. The English edition was last before us in respect of Volume 11, No. 12, and Volume 12, Nos. 1–3, and decision No. 889 of 14 November 1977 found them to be indecent.
