Revoking as to Part a Proclamation Taking Land for the
Tauranga-Te Maunga Motorway in Block XIV, Tauranga
Survey District, Tauranga County

A PROCLAMATION
PURSUANT to the Public Works Act 1928, I, Sir Edward
Denis Blundell, the Governor-General of New Zealand,
hereby revoke the Proclamation dated the 2nd day of October
1974, and published in the Gazette, No. 100, of the 10th day
of October 1974, at page 2132, taking land for the Tauranga-
Te Maunga Motorway, in so far as it affects the land described
in the Schedule hereto, such land being no longer required.
SCHEDULE
SOUTH AUCKLAND LAND DISTRICT
ALL that piece of land containing 849 square metres, situated
in Block XIV, Tauranga Survey District, being part Allotment
31, Te Papa Parish; as shown on plan M.O.W. 28127 (S.O.
47514) deposited in the office of the Minister of Works and
Development at Wellington and thereon marked 'J'.
Given under the hand of His Excellency the Governor-
General and issued under the Seal of New Zealand this
23rd day of August 1977.

The Waiau Plains Irrigation Order 1977

ORDER IN COUNCIL
At the Government Building at Wellington this 22nd day
of August 1977
Present:
THE RIGHT HON. R. D. MULDOON PRESIDING IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the
Governor-General, acting by and with the advice and consent
of the Executive Council hereby makes the following order.
ORDER
-
This order may be cited as the Waiau Plains Irrigation
Order 1977. -
The Minister of Works and Development is hereby
authorised to construct, maintain, and control the water-
supply works described in the First Schedule hereto to serve
the district described in the Second Schedule hereto. -
The area of land described in the said Second Schedule
is hereby constituted as an irrigation district, to be known
as the Waiau Plains Irrigation District (herein referred to as
"the district"). -
It is hereby declared that the basic charge payable on
all irrigable land within the said district shall be $10.00 an
irrigable-hectare-a-year and the water availability charge which
replaces the basic charge for each farm when a farm development
plan has been agreed upon shall be:
(a) For border dyke irrigation—$1,000.00 a season for one
roster day each week;
(b) For spray irrigation—$20.00 a year for each litre per
second continuous supply.

Basis of allocation—For border dyke irrigation one roster
day per week will be sufficient for about 75 hectares of
irrigable land. For spray irrigation 50 l/s continuous supply
will be sufficient for about 90 hectares of irrigable land. -
Reduction shall be made to the charges given above during
the first six irrigation seasons so that the charges for the first
seven seasons shall be as set out in the Third Schedule hereto. -
It is hereby declared that after the seventh season of
water availability, both basic and availability charges may be
adjusted annually to take account of variations between
estimated and actual construction costs, variations between,
estimated and actual costs for operation, maintenance and
renewals, changes in interest rates with Rural Banking and
Finance Corporation, and variations in quantity of water used
or subject to availability agreements.
FIRST SCHEDULE
WATER SUPPLY WORKS
THE Waiau Plains Irrigation Works by which means water
can be drawn from the Waiau River and from any dam or
dams which are or may be constructed or acquired on the
said river or any other river or stream, such water being
conveyed in the district by a race or races constructed or
acquired by the Minister of Works and Development, or by
any enlargement or extension thereof; the said works including
all dams, reservoirs, water races, weirs, siphons, piping, gauge
boxes, valves, bridges, pumps, spillways, regulating gates,
meters, and all other works incidental to or required for the
construction, maintenance, and control of the said works for
the irrigation of the district.
SECOND SCHEDULE
Waiau Plains Irrigation District
ALL that area in the Canterbury Land District, Amuri and
Cheviot Counties, containing 30,800 hectares, more or less,
bounded by a line commencing at the south-westernmost
corner of Rural Section 37842, in Block XIV, Culverden
Survey District, and proceeding north-westerly along the south-
western boundaries of that section and Rural Sections 39290
and 39289 to the south-eastern boundary of Lot 3, D.P.
2548; thence south-westerly along that boundary and north-
westerly along the south-western boundaries of Lots 3 and 2,
D.P. 2548, to the western corner of the last-mentioned lot;
thence westerly along a right line to the southern corner
of Lot 1, D.P. 10348; thence north-westerly along the south-
western boundaries of Lots 1 and 2, D.P. 10348, and the
production of the last-mentioned boundary to the middle of
the Waiau Branch Railway; thence north-easterly along the
middle of that railway to the middle of Long Plantation
Road; thence north-westerly along the middle of that road
to a point in line with the western boundary of Lot 8, D.P.
2625; thence northerly to and along that boundary to the
right bank of the Pahau River; thence north-easterly along
a right line to the westernmost corner of Section 16, Culverden
Settlement; thence north-easterly and south-easterly along the
north-western and north-eastern boundaries of that section and
the production of the last-mentioned boundary to the middle
of Hamiltons Road; thence northerly along the middle of
that road to the southern boundary of Section 27, Culverden
Settlement; thence northerly generally along the generally
eastern boundary of that section to the southern boundary
of Lot 1, D.P.'s 3944-7 and 3953; thence westerly generally
along the generally southern boundary of that lot to the
left bank of the Pahau River; thence northerly along that
bank and easterly along the northern boundary of the said
Lot 1 and the production of that boundary to the eastern
side of the No. 7 State Highway (Reefton-Waipara); thence
northerly along that roadside to the south-western boundary
of Lot 1, D.P. 5177; thence south-easterly along that boundary
to the right bank of the Waiau River; thence easterly
generally along that bank to the westernmost corner of Lot 40,
D.P. 10 Amuri, in Block XV, Lyndon Survey District; thence
south-easterly along the south-western boundary of that lot
and its production to the south-eastern side of No. 70 State
Highway (Waiau-Rotherham); thence north-easterly, south-
easterly, and south-westerly, along the north-western, north-
eastern, and south-eastern boundaries of Lot 1, D.P. 4534,
to the northern boundary of Lot 4, D.P. 4163; thence
easterly along that boundary and northerly along the western
boundary of Lot 3, D.P. 4163, and its production to the
middle of Green Road; thence north-westerly along the middle
of that road to a point in line with the north-western boundary
of Lot 2, D.P. 4163; thence north-easterly to and along
that boundary to its northernmost corner; thence southerly
generally along the generally eastern boundary of the said
Lot 2 to the north-eastern side of Green Road; thence south-
easterly along that roadside to the southern boundary of
Lot 2, D.P. 4160; thence easterly generally along the generally
southern boundaries of Lots 2 and 1, D.P. 4160, and the
production of the last-mentioned boundary to the right bank
of the Waiau River; thence south-easterly generally along
that bank to the generally eastern boundary of that part
of Section 200, Square 88 Amuri, comprised in C.T. 408/225
L.T.D. in Block III, Lowry Peaks Survey District; thence
southerly generally along that boundary to the north-eastern
boundary of the land comprised in C.T. 408/226 L.T.D.;
thence north-westerly generally along that boundary through
Sections 200, 89, and 204, Square 88 Amuri, to the northern-
most corner of the land comprised in that certificate of
title; thence north-westerly, south-westerly, and south-
easterly generally along the generally north-eastern, north-
western, and south-western boundaries of the land comprised
in C.T. 408/197 L.T.D., through Sections 204, 200, and 203,
Square 89 Amuri and Sections 201 and 202 Square 88 Amuri
Sections 70 and 56, Square 84 Amuri, Sections 263 and 49,
Square 89 Amuri, Section 48, Square 84 Amuri, Section 164,
Square 89 Amuri, Sections 201, 202, Square 88, Amuri
to the generally north-western boundary of the land com-
prised in C.T. 408/226 L.T.D.; thence south-westerly generally
along that boundary through Sections 202, 206, and 205,
Square 88 Amuri, and Section 168, Square 89 Amuri, to
the north-eastern boundary of Lot 1, D.P. 1931; thence
