Special Order Made by Mackenzie County Council Altering Riding Boundaries

PURSUANT to section 88 of the Counties Act 1956, the Secretary for Local Government hereby publishes the following Special Order made by the MacKenzie County Council.

SPECIAL ORDER

That, in pursuance and exercise of the powers vested in it in that behalf by the Counties Act 1956 and amendments thereto enabling it, the Mackenzie County Council hereby resolves by way of Special Order as follows:

(a) To increase the number of members of the Mackenzie County Council from 9 to 10 members.

(b) To increase the number of ridings from 5 to 6 Ridings.

(c) To alter the boundaries of the existing Tekapo Riding by excluding therefrom the area described in the Schedule attached.

(d) To constitute the area described in the Schedule attached as a separate riding of the Mackenzie County Council with one representative on the said council.

(e) To name the new riding the Twizel Riding and to further resolve that its constitution become effective as from the 1977 local authority elections.

This Special Order was passed at a meeting of the Mackenzie County Council, held on 4 February 1977, and was duly confirmed at a meeting of the said council held on 1 April 1977.

The Common Seal of the Chairman, Councillors, and Inhabitants of the County of Mackenzie was hereunto affixed in the presence of:

SCHEDULE

TWIZEL RIDING OF MACKENZIE COUNTY

ALL that area in the Canterbury Land District, County of Mackenzie, containing 998 hectares, more or less, bounded by a line commencing at a point on the middle line of “Glen Lyon Road”, distant 1.8 kilometres from the intersection of that middle line and the middle line of No. 8 S.H., Block VIII, Strachey Survey District, and proceeding north-easterly along a line bearing 42° 00′ to the right bank of Fraser Stream; thence south-easterly generally along that bank to the south-eastern boundary of the land set apart for generation of electricity by New Zealand Gazette, 1971, p. 3024; thence south-westerly along that boundary and its production to the middle of “Glen Lyon Road”; thence south-easterly along that middle line to the middle line of No. 8 S.H.; thence south-westerly along that middle line to a point in line with the left bank of the Ohau River; thence to and along that bank to a point on a line bearing 222° 00′ from the point of commencement; thence north-easterly along that line to the point of commencement.

I, Brian John Dwyer, County Clerk to the Mackenzie County Council, hereby certify that the Special Order amending the boundary of the Tekapo Riding as confirmed by the said Council, on 1 April 1977, has been duly made in terms of the Counties Act 1956 and its amendments.

Licensing John Maxwell Lester to Occupy a Site for Mooring Piles at Henderson Creek

PURSUANT to section 162 of the Harbours Act 1950, I, Owen John Conway, of the Ministry of Transport, hereby license and permit John Maxwell Lester (hereinafter called the licensee, which term shall include his administrators, executors or assigns, unless the context requires a different construction) to use and occupy a part of the bed of the Henderson Creek, Te Atatu, as shown on plan marked M.D. 13939 and deposited in the office of the Ministry of Transport at Auckland, for the purpose of maintaining thereon mooring piles as shown on the said plan, such licence to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.

The licence of 14 October 1970, authorising Desmond Clive Reid and Ruth Edith Reid to use and occupy a part of the bed of Henderson Creek, Te Atatu, and now held in the name of Roy Powell Mann, is hereby revoked*.

SCHEDULE

CONDITIONS

(1) This licence is subject to the Foreshore Licence Regulations 1960, and the provisions of those regulations shall, so far as applicable, apply hereto.

(2) The term of the licence shall be two years from the 1st day of March 1977.

(3) The premium payable by the licensee shall be ten dollars ($10) and the annual sum so payable by the licensee shall be forty dollars ($40); provided always that the Minister may review the annual sum payable at the end of the first year or any subsequent year of the said term.

Licensing William Edward Johnson, Trading as Medora Fisheries to Occupy a Site for a Landing Jetty, Freezer, and Shed in Blanket Bay, Doubtful Sound

PURSUANT to section 162 of the Harbours Act 1950, I, Owen John Conway, of the Ministry of Transport, in exercise of powers delegated by the Minister of Transport, hereby license and permit William Edward Johnson, trading as Medora Fisheries (hereinafter called the licensee, which term shall include his administrators, executors or assigns, unless the context requires a different construction) to use and occupy a part of the foreshore and bed of Blanket Bay, Doubtful Sound, as shown on plan marked M.D. 13777 and M.D. 15340, and deposited in the office of the Ministry of Transport at Christchurch, for the purpose of maintaining thereon a landing jetty, freezer, and shed as shown on the said plan, such licence to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE

CONDITIONS

(1) This licence is subject to the Foreshore Licence Regulations 1960, and the provisions of those regulations shall, so far as applicable, apply hereto.

(2) The term of the licence shall be 2 years from the 1st day of July 1976.

(3) The premium payable by the licensee shall be fifteen dollars ($15) and the annual sum so payable by the licensee shall be one hundred and fifty dollars ($150); provided always that the Minister may review the annual sum payable at the end of the first year or any subsequent year of the said term.

(4) The licensee shall at all times during the continuance of the licence maintain the structures in good order and repair.

(5) In accordance with regulation 13 of the Regulations this licence may be revoked by the Minister without liability for compensation after at least 3 calendar months previous notice in writing or at any time, if the licensee commits a breach of these regulations.

(6) In accordance with regulation 14 of the regulations, all structures are to be removed and the foreshore restored to its original condition within one month of the expiry of this licence, unless it is renewed, or within 1 month of the date of revocation of the licence.

(7) This licence is granted only in respect of the site for the aforementioned structures and does not confer any rights of access or usage of land above high water ordinary spring tides, such land being Crown land under the control of the Fiordland National Park Board.

Consenting to Raising of Loans by Certain Local Authorities

PURSUANT to the Local Authorities Loans Act 1956, the undersigned Deputy Secretary to the Treasury, acting under powers delegated to the Secretary to the Treasury by the Minister of Finance, hereby consents to the borrowing by the local authorities, mentioned in the Schedule hereto, of the whole or any part of the respective amounts specified in that Schedule.
