Notice of Intention to Vary Hours of Sale of Liquor at Licensed Premises—Mataura Licensing Trust

PURSUANT to section 34B (10) of the Licensing Trusts Act 1949, as amended by section 14 of the Licensing Trusts Amendment Act 1970, I, Gordon Stewart Orr, Secretary for Justice, hereby give notice that the Mataura Licensing Trust on 6 May 1977 applied for orders, which were granted in the Magistrate’s Court at Gore on Wednesday, 25 May 1977, authorising variations of the usual hours of sale of liquor to the public, and further authorised the following hours of trading for the licensed premises specified in the Schedule below:

(a) On every Monday, Tuesday, Wednesday, and Thursday (not being Christmas Eve or New Year’s Eve, nor days when licensed premises are required to be closed for the sale of liquor to the general public) the hour of opening shall be 11 o’clock in the morning and the hour of closing 10 o’clock in the evening.

(b) On every Friday and Saturday (not being New Year’s Eve, nor days when licensed premises are required to be closed for the sale of liquor to the general public) the hour of opening shall be 11 o’clock in the morning and the hour of closing shall be 11 o’clock in the evening.

(c) On every New Year’s Eve (not being a day when licensed premises are required to be closed for the sale of liquor to the general public) the hour of opening shall be 11 o’clock in the morning of New Year’s Eve and the hour of closing 0.30 o’clock in the morning of New Year’s Day.

(c) On every Friday and Saturday (not being Christmas Eve or New Year’s Eve, nor being a day when licensed premises are required to be closed for the sale of liquor to the general public) the hour of opening shall be 12 noon and the hour of closing 11 o’clock in the evening.

(d) On every New Year’s Eve (not being a day when licensed premises are required to be closed for the sale of liquor to the general public) the hour of opening shall be 12 noon on New Year’s Eve and the hour of closing 0.30 o’clock in the morning of New Year’s Day.

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the following publications: Penthouse, U.S., Vol. 8, No. 3, 6, and 7 (being the November 1976 and February and March 1977 issues).

DECISION

The Tribunal last considered the American edition of Penthouse late in 1976, and after an extended hearing found the issues then before it to be indecent in the hands of persons under the age of 18 years. (Decision No. 881 of 23 December 1976). The Comptroller of Customs has now applied for a restriction order in terms of s. 15A of the Act, and this is not opposed by counsel for the publishers.

The three issues now before us have been carefully examined by the Tribunal which is of the view that their general level is the same as that of the issues dealt with in decision No. 881—they have neither improved nor deteriorated.

The Tribunal reiterates its view expressed in the earlier decision that Penthouse is very close to the borderline between the acceptable and the unacceptable.

The Tribunal accordingly classifies these three issues of Penthouse as indecent in the hands of persons under the age of 18 years, and makes a restriction order under s. 15A of the Act in similar terms for a period of 2 years.
