Council, the Wellington Education Board has acquired the hall and the site on which it was situated by means of its powers of compulsory acquisition.
The grounds of the application are:
(i) That the purpose for which the Wainuiomata public hall was established is now being undertaken by the Wainuiomata community centre, and the compensation monies are inadequate for the construction of a further new public hall, and would be better applied to some other purpose beneficial to the people of Wainuiomata.
(ii) That it appears that the council holds the monies upon trust for a charitable purpose and the carrying out of the trust upon which it is held could be facilitated by extending and varying such powers as may be available to the council in its disposition of the said monies for the benefit of the people of Wainuiomata.
The purpose of the scheme is to enable the council to apply the monies towards the cost of extensions to the existing library facilities in Wainuiomata which extensions have now been completed.
A copy of the scheme and other papers filed by the council, which are numbered M110/77, may be inspected at the Wellington Registry of the Supreme Court by application to the Registrar. The council’s application is set down for hearing in the Supreme Court on Wednesday, the 1st day of June 1977, at 10 o’clock in the forenoon.
Any person opposing the scheme is required to give written notice of his intention so to do to the Registrar of the Supreme Court at Wellington; to the council’s Solicitors Messrs Brandon Ward Evans-Scott & Hurley, P.O. Box 36, Wellington; and to the Attorney-General at the Crown Law Office, P.O. Box 5012, Wellington, at least 7 clear days before the above-mentioned date of hearing.
