SECOND SCHEDULE

Her Majesty or the Governor-General and all officers in the Government service acting in the execution of their duty shall, at all times, have free ingress, passage, and egress into, over, and out of the foreshore described in the First Schedule to this order, without payment.

Nothing herein contained shall authorise the Board to do, or cause to be done, anything repugnant to, or inconsistent with, any law relating to the Customs, or with any provision of the Harbours Act 1950 or its amendments, or any regulations made thereunder that are, or may hereafter be, in force.

The rights, powers, and privileges conferred by this Order in Council shall not apply to those portions of the foreshore required for securing the shore ends of any telegraph cables that are at present, or may be at any time laid down within the said area of foreshore.

The Board may enclose any part or parts of the foreshore, described in the First Schedule hereto, for the purpose of holding athletic sports or games and may, by bylaws, fix a charge for admission to such enclosed part or parts:
Provided that the total number of days on which such enclosures are made shall not exceed 6 in any 1 year. -
Nothing herein contained shall authorise the Board to remove, or cause to be removed, any stone, sand, shingle, or shells without the consent of the Minister being first obtained.

The Board may, subject to the provisions of section 178 of the Harbours Act 1950, erect or license or permit the erection of bathing sheds, boat sheds, boat building sheds, jetties, or slipways on the foreshore described in the First Schedule hereto, and may make bylaws regulating the use thereof, and may fix charges for such use: Provided that the funds so received shall be expended in improving the foreshore for the benefit of the public.

Bylaws made by the Board under the authority of this Order in Council shall not come into force until they have been approved by the Minister, by notice in the Gazette.

The said rights, powers, and privileges may be at any time resumed by the Governor-General, without payment or any compensation whatever, on giving to the Board 6 calendar months’ notice in writing. Any such notice shall be sufficient if given by the Minister and delivered at, or posted to, the last-known address of the Board in New Zealand.

Appointments, Promotions, Extensions, Relinquishments, Cancellations, Transfers, Resignations and Retirements of Officers in the New Zealand Cadet Forces
Pursuant to section 59 of the Defence Act 1971, the Minister of Defence hereby approves the following appointments, promotions, extensions, relinquishments, cancellations, transfers, resignations and retirements of officers of the New Zealand Cadet Forces:
SEA CADET CORPS
Appointments
Michael Peter Doole is appointed to a cadet commission in the rank of Sub Lieutenant on probation for a period of three years, with seniority and effect from 29 October 1976.
John Donald Ferguson is appointed to a cadet commission in the rank of Sub Lieutenant on probation for a period of three years, with seniority and effect from 9 November 1976.
Resignations
The following cadet officers resign their cadet commission with effect from dates as shown:
Lieutenant K. M. Farmer, 4 November 1976.
Lieutenant H. F. Bradley, 16 December 1976.
Lieutenant G. G. Bond, 1 January 1977.
Retirement
Sub Lieutenant C. W. Malcolm is retired, with effect from 1 December 1976.

Appointment
David Kenneth Douglas Collier is appointed to a cadet commission in the rank of 2nd Lieutenant on probation for a period of three years, with seniority and effect from 20 October 1976.

Bruce Frederick Wilkinson is appointed to a cadet commission in the rank of Pilot Officer on probation for a period of three years, with seniority and effect from 17 November 1976.
Extensions
The following cadet officers are granted an extension of their cadet commission to 1 November 1979:

Termination
Flying Officer L. R. Clarkson’s cadet commission is terminated, with effect from 26 June 1976.
Transfers
Pilot Officer D. H. Green is transferred from No. 14 (Gisborne) ATC Squadron to No. 2 (Petone) ATC Squadron, with effect from 26 October 1976.
Pilot Officer G. E. Crase is transferred to the Supernumerary List for a period of one year, with effect from 1 November 1976.
