Local Authorities Loans Act 1956—General Variation of Conditions of Borrowing

PURSUANT to section 9 (4A) of the Local Authorities Loans Act 1956 (as inserted by section 4 (3) of the Local Authorities Loans Amendment Act 1967) notice is hereby given that the Local Authorities Loans Board, acting with the approval of the Minister of Finance, has determined as follows:

  1. This general determination shall apply to all money, which any local authority has received the sanction of the Board, given before the date of this notice, to borrow by way of special loan, other than money borrowed before the 13th day of August 1976.

  2. No money to be repaid by equal aggregate yearly or half-yearly instalments of principal and interest shall be borrowed for a term of less than 6 years.

  3. No money to be repaid out of a sinking fund shall be borrowed for a term of less than 6 years, provided that a portion of such money, not exceeding 40 percent thereof, may be borrowed for terms of 3 and/or 5 years.

  4. All sanctions to which this general determination applies shall be varied accordingly.

Consenting to Raising of Loans by Certain Local Authorities

PURSUANT to the Local Authorities Loans Act 1956, the undersigned Assistant Secretary to the Treasury, acting under powers delegated to the Secretary to the Treasury by the Minister of Finance, hereby consents to the borrowing by the local authorities, mentioned in the Schedule hereto, of the whole or any part of the respective amounts specified in that Schedule.

The Road Classification (Marlborough County Council) Notice No. 2, 1976

PURSUANT to regulation 3 of the Heavy Motor Vehicle Regulations 1974*, the Secretary for Transport hereby gives the following notice.

NOTICE

  1. This notice may be cited as the Road Classification (Marlborough County Council) Notice No. 2, 1976.

  2. The Marlborough County Council’s proposed classification of the road, as set out in the Schedule hereto, is hereby approved.

  3. So much of the notice, dated the 3rd day of July 1950† and the notice, dated the 27th day of April 1976‡, which relate to the classification of the roads, described in the Schedule hereto, are hereby revoked.

Decision of the Indecent Publications Tribunal

IN the matter of the Indecent Publications Act 1963, and in the matter of an application by Patrick Campbell, acting on behalf of Waverley Publishing Co. Ltd. for a decision in respect of the publication Story of O, by Pauline Reage, published by Grove Press, of New York.

BEFORE THE INDECENT PUBLICATIONS TRIBUNAL

Hearing: 14 June 1976.

Appearances: No appearances but written submissions were received from the applicant.

DECISION OF THE TRIBUNAL

This is a paper-back edition of a book which was before the Tribunal in November 1967 (Decision No. 54, New Zealand Gazette, 23 November 1967). Its circulation was then restricted among professional psychiatrists.

It is now urged on us that this classification is out of date, having regard to changed classifications of other books, the distribution in other countries of a film version, favourable reviews by well known writers, and changes in the climate of public opinion.

As was said by the tribunal previously the book is in the tradition of de Sade but it is, in our view, worse and remains indecent.

The tribunal classifies this book as indecent unless its circulation is restricted to professional psychiatrists and clinical psychologists.
