Price Order No. 22 (Australian Oranges)
PURSUANT to the Commerce Act 1975, I, Desmond James Gasson, pursuant to a delegation from the Secretary of Trade and Industry, hereby make the following price order:

This order may be cited as Price Order No. 22 and shall come into force on the 15th day of June 1976.

(1) Price Order No. 2320* is hereby revoked.
(2) The revocation of the said orders shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this order. -
References in this order to metropolitan areas are references to the metropolitan areas described in the Schedule hereto.
APPLICATION OF THIS ORDER
- This order applies with respect to all Australian oranges sold by way of retail in New Zealand.
MAXIMUM RETAIL PRICES
- (1) Subject to the provisions of this clause, the maximum price that may be charged or received by any retailer for any Australian oranges shall be:
(a) When sold by a retailer carrying on business in any of the metropolitan areas of Auckland, Wellington, Christchurch, or Dunedin, or in any of the cities or boroughs of Whangarei, Takapuna, Hamilton, Tauranga, Rotorua, Gisborne, New Plymouth, Stratford, Hawera, Wanganui, Palmerston North, Napier, Hastings, Masterton, Blenheim, Nelson, Greymouth, Timaru, Westport, Oamaru, Balclutha, Gore, or Invercargill—
35 cents per pound.
or where the scales used by the retailer weigh in metric weights—
77 cents a kilogram.
(b) When sold by a retailer carrying on business elsewhere—
1 lb, 36 cents;
2 lb, 71 cents;
3 lb, $1.07;
4 lb, $1.42;
5 lb, $1.78;
6 lb, $2.13.
Fractions of a pound shall be calculated at the rate of 36 cents per pound. Quantities in excess of 6 lb shall be calculated at the rate of 35.5 cents per pound.
Or where the scales used by the retailer weigh in metric weights—
1 kg, 78 cents;
2 kg, $1.56;
3 kg, $2.34.
Fractions of a kilogram shall be calculated at the rate of 78 cents per kilogram. Quantities in excess of 3 kg shall be calculated at the rate of 78 cents per kilogram.
(2) If in respect of any lot of oranges sold by a retailer the maximum price calculated in accordance with the foregoing provisions of this clause is not an exact number of cents, the maximum price of the lot may be computed to the nearest whole cent.
SPECIAL PRICES WHERE EXTRAORDINARY CHARGES INCURRED
- Subject to such conditions, if any, as it thinks fit, the Secretary, on application by any retailer, may authorise special prices in respect of any Australian oranges to which this order applies where special circumstances exist, or for any reason extraordinary charges (freight or otherwise) are incurred by the retailer. Any authority given by the Secretary under this clause may apply with respect to a specified lot or consignment of oranges or may relate generally to all Australian oranges to which this order applies sold by the retailer while the approval remains in force.
DUTY IMPOSED ON RETAILERS
- Every retailer who offers or exposes any Australian oranges for sale in any shop shall keep in a prominent position in such proximity to the oranges to which it relates as to be obviously descriptive thereof, a ticket, placard, or label on which shall be stated in legible and prominent characters the following particulars:
(a) The retail price per pound or, where the scales used by the retailer weigh in metric weights, the price per kilogram.
(b) The word “Australian”.

Price Order No. 23 (Spirits and Beer)
PURSUANT to the Commerce Act 1975, I, Desmond James Gasson, pursuant to a delegation from the Secretary of Trade and Industry, hereby make the following price order:
PRELIMINARY

This order may be cited as Price Order No. 23 and shall come into force on the 11th day of June 1976.

(1) Price Orders No. 3* and 18† are hereby revoked.
(2) The revocation of the said price orders shall not affect the liability of any person for any offence in relation thereto committed before the coming into force of this order. -
In this order, unless the context otherwise requires—
“Litre” means litre as defined in the Weights and Measures Metric Equivalents Order 1972†;
“Millilitre or ml” means millilitre as defined in the Weights and Measures Metric Equivalents Order 1972†;
“Ounce” means fluid ounce as defined in the Weights and Measures Proclamation 1946‡;
“Standard Measure” means five-eighths of an ounce;
“Quart” means a bottle customarily referred to in the licensed trade as a quart bottle, and having a capacity of approximately 26⅔ oz;
“Licensing Trust” means any Licensing Trust to which the Licensing Trusts Act 1949 applies and includes the Invercargill Licensing Trust and the Masterton Licensing Trust;
“Bacardi” means rum sold under the trade name of Ron Bacardi;
“Imported Whisky” means all imported whisky and includes Scotch, Bourbon, Rye, Corn, Irish, or Japanese whisky;
“New Zealand Whisky” means whisky produced and blended in New Zealand by Wilson Distillers Ltd., Dunedin;
“Ron Barbado” means that spirit sold under the trade name of Ron Barbado. -
In this order, unless the context otherwise requires—
(a) The Act means the Commerce Act 1975, and
(b) Terms and expressions defined in the Act have the meanings so defined.
