Thirdly, all that area being Rural Section 26794, situated in Block VI, Rangiora Survey District.

(ii) The annual basic charge which shall be payable in respect of all irrigable land in the proposed irrigation district shall be $30 per hectare of irrigable land.

(iii) The annual water availability charge shall be $160 per litre per second flow available to each property.

(iv) The basic charge and water availability charge shall be reduced during the first 6 seasons of supply to those charges set out in the Schedule hereto.

(v) The charges have been based on the estimated development and maintenance costs of the proposed scheme, and shall be subject to annual adjustment from the end of the seventh season of supply to compensate for any difference in any element of these charges from the amount previously estimated, under sections 13 and 15 of the Act, and as stated above.

(vi) The object of the scheme is to provide a reliable water supply for irrigation of land within the proposed district by a piped water supply from the Okuku River to a storage reservoir, and from this point it will be either reticulated to a holding tank on the property, as appropriate, to enable trickle-irrigation of established and proposed orchards, as well as limited areas of other horticultural crops.

(vii) It is estimated that the scheme is capable of providing a reliable water supply for all of the proposed district.

(viii) Supply of water is subject to the terms of the Water Right Number NCY 730544, issued by the North Canterbury Regional scheme. This right provides for the continuous removal of 4582 cubic metres per day at a rate not exceeding 53 litres per second from the Okuku River. The right is subject to the condition that the taking of water is to be rostered by all grantees to maintain a flow of at least 160 litres per second in the Ashley River at the No. 1 State Highway bridge. (A drought requiring this type of rostering is envisaged about once in 10 years on average.) The water right allows an average supply of 2.25 litres per tree, continuously every hour, and on an assessed tree density of 333 trees per hectare for all the defined irrigable area, provided the water supply permits the exercising of the full right granted.

(ix) The proposed scheme is to be constructed as a whole and can be brought into full operation during the 1976-77 season.

(x) The Minister requires not less than 60% of valid votes cast in the poll, to be held under Part XI of the Public Works Act 1928, to be in favour of the proposed irrigation scheme as a prerequisite to its construction.

(xi) The minimum aggregate area of land occupied by any occupier that it is proposed to include in the proposed irrigation scheme shall be one hectare.
