Land Taken for Flood Protection Works in the City of Manukau and the City of Papatoetoe
DENIS BLUNDELL, Governor-General A PROCLAMATION PURSUANT to the Public Works Act 1928, I, Sir Edward Denis Blundell, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the Schedule hereto is hereby taken for flood protection works and shall vest in the Mayor, Councillors, and Citizens of the City of Manukau as from the date hereinafter mentioned; and I also declare that this Proclamation shall take effect on and after the 14th day of April 1976.
SCHEDULE NORTH AUCKLAND LAND DISTRICT ALL that piece of land containing 1 rood and 13.9 perches, situated in the City of Manukau and the City of Papatoetoe, and being part Lot 3, D.P. 57319; as shown coloured blue on plan M.O.W. 27792 (S.O. 47472) deposited in the office of the Minister of Works and Development at Wellington. Transfer of Refuse Disposal Function to the Auckland Regional Authority DENIS BLUNDELL, Governor-General ORDER IN COUNCIL At the Government Buildings at Wellington this 29th day of March 1976 Present: THE RIGHT HON. R. D. MULDOON PRESIDING IN COUNCIL PURSUANT to the Local Government Act 1974, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
ORDER 1. This order shall come into force on 1 May 1976. 2. The functions of every constituent authority within the Auckland Regional District in relation to the disposal of refuse (in this order referred to as “the function”) shall be transferred to the Auckland Regional Authority (in this order referred to as “the Authority”).
3. Nothing in this order shall authorise the Authority to collect any refuse from any place or to transport any refuse to any place except as may be necessary for the ultimate disposal of refuse deposited at facilities provided by the Authority for refuse of that kind. 4. After this order comes into force, the Authority shall, by special order, appoint a date on which the function shall be transferred from each constituent authority to the Authority, being a date not earlier than 6 months after the making of that special order; and the provisions of subsection (2) of section 73 of the Local Government Act 1974, shall not apply to such transfer: Provided that the function may, by agreement between the Authority and any constituent authority, be undertaken by that constituent authority to the extent and in the manner so agreed. Provided, further, that in appointing the date of such transfer, the Authority shall have regard to any representations made by or on behalf of that constituent authority. 5. The provisions of subsections (2), (3), (4), (5), and (6) of section 96 of the Local Government Act 1974, shall apply in respect of such transfer as if the Authority undertakes the function by agreement with each constituent authority, and as if for the purposes of subsection (3) of the said section 96, the date of the transfer is a term under which the transfer is to be effected. 6. The function shall be deemed to be a public work for the purpose of the Public Works Act 1928. 7. The functions and powers conferred on the Authority, pursuant to this order, shall be in addition to any other functions and powers of the Authority. P. G. MILLEN, Clerk of the Executive Council. (I.
