Constitution of the Tasman Electric Power Board

At the Government Buildings at Wellington, this 22nd day
of March 1976
Present:
THE RIGHT HON. R. D. MULDOON PRESIDING IN COUNCIL
WHEREAS by Proclamation, dated the 16th day of June 1925,
and published in the Gazette, on the 18th day of June 1925,
the Golden Bay Electric Power District as therein described
was duly constituted as an electric power district within the
meaning of the Electric Power Boards Act 1925:
And whereas by Proclamation, dated the 1st day of May
1929, and published in the Gazette, on the 2nd day of May
1929, the Waimea Electric Power District as therein described
was duly constituted as an electric power district within the
meaning of the Electric Power Boards Act 1925:
And whereas the districts controlled by the Golden Bay
Electric Power Board and the Waimea Electric Power Board
have since the respective dates of the constitution of the
Boards been extended, modified, and amended:
And whereas it is desirable to amalgamate the electric
undertakings and districts of the Golden Bay Electric Power
Board and the Waimea Electric Power Board under a new
electric power board to be hereby constituted under the
Electric Power Boards Act 1925:
And whereas by special order of the Golden Bay Electric
Power Board, confirmed on the 21st day of August 1975,
and by special order of the Waimea Electric Power Board,
confirmed on the 20th day of August 1975, it was resolved
that the amalgamation of the two Boards be recommended:
And whereas the Local Government Commission has re-
commended the amalgamation in terms of the Local Govern-
ment Act 1974:
Now, therefore, pursuant to the Electric Power Boards Act
1925 and the Local Government Act 1974, His Excellency the
Governor-General, acting by and with the advice and con-
sent of the Executive Council, hereby makes the following
order.
ORDER
- The Tasman Electric Power District—
(i) The area defined in the First Schedule to this
order is hereby constituted as the Tasman Electric
Power District.
(ii) The outer area of the district so formed shall
consist of the area described in the Second Schedule
hereto. - The Tasman Electric Power Board—The Tasman Electric
Power Board is hereby constituted for the purpose of ad-
ministering the supply of electricity in the Tasman Electric
Power District. - Representation—
(i) The constituent districts which are bracketed
together in the first column of the Third Schedule
to this order shall be a combined district, and the
local authority of the constituent district, distinguished
by the letter "(P)", shall be the principal local
authority of the combined district.
(ii) The number of representatives of each con-
stituent district or combined district shall be the
number specified in the Third Schedule to this order
opposite the name of that constituent district or com-
bined district. Provided that until the next triennial
local body elections the total number of the present
members of the Waimea Electric Power Board and
the Golden Bay Electric Power Board shall be the
number of representatives of the Tasman Electric
Power Board.
(iii) The first representatives of the constituent dis-
tricts and combined districts shall be the present
members of the Golden Bay and Waimea Electric
Power Boards and shall hold office until the next
triennial local body election. All subsequent re-
presentatives of the constituent districts and combined
districts shall be elected by the electors of the said
constituent districts and combined districts. - First Meeting of Board—The first meeting of the Tasman
Electric Power Board shall be held at the office of the Board
in Richmond, at 11 a.m., on the 24th day of March 1976. - Functions, Powers, and Responsibilities of Board—The
Tasman Electric Power Board shall have all the powers,
righrs, duties, obligations, and responsibilities of an electric
power board constituted under the Electric Power Boards
Act 1925, and the provisions of the Electric Power Boards
Act 1925, in so far as they are not contrary to this order
shall apply to the board. - Staff—In accordance with the Local Authorities (Employ-
ment Protection) Act 1963. and under such terms and condi-
tions as may be agreed upon, the board shall continue to
employ all permanent employees of the Golden Bay and
Waimea Electric Power Boards, who elect to transfer to the
board, provided the conditions of employment shall be no
less favourable than those enjoyed formerly.
