PURSUANT to the Local Authorities Loans Act 1956, the undersigned Assistant Secretary to the Treasury, acting under powers delegated to the Secretary to the Treasury by the Minister of Finance, hereby consents to the borrowing by the local authorities mentioned in the Schedule hereto of the whole or any part of the respective amounts specified in that Schedule.

Decision of the Indecent Publications Tribunal

In the matter of the Indecent Publications Act 1963, and in the matter of a reference by the Magistrate’s Court, Christchurch for a decision in respect of the publication Aequus, February 1975, Volume 2, Number 2, published by Gay Liberation Front, Christchurch.

Date of Hearing: 3 November 1975, at Wellington.

Appearances: Mr. J. B. Phelan for the Police; Mr. P. R. H. Maling appeared as author.

Subsequent written submissions were received on behalf of Mr M. S. Waghorne and were considered together with additional submissions from the Police and Mr Maling.


DECISION OF THE TRIBUNAL

This magazine is published monthly as the newsletter of an association called “Gay Liberation Front, Christchurch”.

The issue before us bears the date February 1975 and is almost entirely taken up by an article entitled “An introduction to homosexual anal intercourse” written by P. R. H. Maling, the defendant in the Court proceedings.

The article deals in some detail with the technique, the pleasures, and the psychological benefits claimed by the author for this type of intercourse, which he states is far superior to any other kind of intercourse.

Mr Maling claims, in summary, that this is the ideal relationship, described by him as “cosmic love”, creating a master and slave relationship between the participants.

Clearly the dominant effect of the magazine is approval of a form of deviant sexual behaviour which is criminal in New Zealand. Its criminality has, at least indirectly, received confirmation by the Parliamentary rejection of a Bill to change the law to allow homosexual acts in private.

We have given consideration, as we must, to the other matters set out in section 11 (1) of the Act. This is not one of these cases where the book or magazine is disqualified under most, if not all, paragraphs of that subsection. Indeed we do not doubt the honesty of the purpose of the author. The limited circulation among this particular group and the alleged possibility of some scientific importance all tend to a classification of not indecent.

However it is the dominant effect, and in particular the criminality of the sexual acts described, which in the end brings us to decide that it is injurious to the public good.

The Tribunal classifies this magazine as indecent.

In the matter of the Indecent Publications Act 1963, and in the matter of an application by Patrick Michael McKee Wright on behalf of Penguin Books (New Zealand) Limited, of Auckland, in respect of the publication More Joy by Alex Comfort.

Date of Hearing: 16 October 1975.

No appearance of the applicant but written submissions were received and considered.

DECISION OF THE TRIBUNAL

More Joy, edited by Alex Comfort, is a companion to The Joy of Sex. Published by Penguin Books in 1975, it is a first Australian edition of the American publication of 1973. A large volume, hard covered and liberally illustrated, it is marketed at a price high enough to give it limited accessibility.

The editor’s preface gives as the scope of More Joy “not more techniques or more elaborate ones (there are not many of these), but the two elements of development and of relation”. This is expanded in the text into a full discussion of the implications for a relationship of physical experience; the range is wide—proprietoriness, jealousy, dependence, role-playing, homosexuality, passivity are among many aspects covered.

The tone is similar to that used in The Joy of Sex, but the emphasis is less on elucidating methods of sexual experiment and more on consideration of the psychological and social implications of sexual experience.

The Tribunal considers that the same restriction should apply to this companion volume, since it similarly is directed towards the understanding of physical aspects of long-term partnerships. It therefore classified More Joy as indecent in the hands of persons under sixteen.
