The Road Classification (National Roads Board) Notice No. 1, 1976
PURSUANT to regulation 3 of the Heavy Motor Vehicle Regulations 1974* the Secretary for Transport hereby gives the following notice.
NOTICE

This notice may be cited as the Road Classification (National Roads Board) Notice No. 1, 1976.

It is hereby declared, as required by the National Roads Board, that the State highway as set out in the Schedule hereto shall belong to the class set out in the said Schedule.

So much of the notice dated the 18th day of June 1965† which relates to the classification of the road described in the Schedule hereto is hereby revoked.

NATIONAL ROADS BOARD ROADS CLASSIFIED IN CLASS ONE
STATE Highway 67 (Westport-Karamea): from the southern abutment of the Karamea River bridge (R.P. 83/17.73) to the Karamea Post Office (R.P. 83/20.48).

Insurance Companies’ Deposits Act 1953—Proposed Release of Deposit
AUSTRALIA and New Zealand Underwriters Limited has given notice to the Public Trustee that it has not carried on the business of insurance in New Zealand and that it proposes to withdraw the deposit which has been made by it with the Public Trustee, pursuant to section 19 of the Insurance Companies’ Deposits Act 1953.
The Public Trustee therefore gives notice, pursuant to section 19 (3) of the abovementioned Act, that he proposes to release to the company on or after the 27th day of February 1976, the amount deposited with him by the company.
Any objections to the release of the amount deposited should be lodged with the Public Trustee at the Public Trust Office, Lambton Quay, Wellington 1, on or before the 13th day of February 1976.

Life Insurance Act 1908—Proposed Release of Deposit
AUSTRALIA and New Zealand Underwriters Limited has given notice to the Public Trustee that it has not carried on the business of life insurance in New Zealand and that it proposes to withdraw the deposit which has been made by it with the Public Trustee, pursuant to section 12 of the Life Insurance Act 1908.
The Public Trustee therefore gives notice pursuant to section 12 (2) of the abovementioned Act, that he proposes to release to the company on or after the 27th day of February 1976, the amount deposited with him by the company.
Any objections to the release of the amount deposited should be lodged with the Public Trustee at the Public Trust Office, Lambton Quay, Wellington 1, on or before the 13th day of February 1976.

DECISION OF THE TRIBUNAL
All the books consist solely of photographs of young boys (pre-puberty upwards), mostly naked but some partly clothed. In general they consist of highly contrived and artificial poses, and clearly come within the third category of the 1968 Waverley decisions (93–103). The claim made by the distributor that several of them fall within the general category of naturist magazines is quite untenable. In the case of Boys International, some previous issues were the subject of decisions No. 618–20 (N.Z. Gazette, 15 March 1973, p. 486); that decision makes clear that the publication then included written material as well as photographs, and that the latter were naturally posed. Neither of these statements applies to the issues now before the Tribunal.
The Tribunal classifies these 10 publications as indecent.
